Ok maybe a long post im looking for advice.

basically i have been told by a the local council that i am no longer allowed to work on bikes in my back garden or in my garage. I am a bike mechanic (unemployed atm) I am not making any money i am merely restoring bikes atm. I have tried to cater to her and avoid making any noise when she has been in her garden. I havent made any noise after 8 and any grinder/drill use has been between the hours of 12 and 6. I do have a lock up at the bottom of the street but have been told i am not allowed to use that either for my "hobby".
Being a council house i am not allowed to run it as a business which i am not.
Basically all this started when i was years ago with my dad she first took it upon herself when my dad was filling up a bike out of a petrol can in the garden. He was given the lockup but found it useless as there is no power source or lighting. 6 years later he built the shed in the back garden again she complained about the power supply and noise.
Now she wasnt complaining a year ago when i was doing work. But since about september she has been. Shed give me dirty looks and such like. At one point she was complaining when i was 200 miles away at college. And again when i came back i decided to polish the frame on a cbr400 that i have. I did it one day and left it for 3/4 weeks.
One night about 7ish i was doing a shock on a mates bike and she was at her window taking pictures. I was going ape when i seen the flash if it wasn`t for my parents i would have gone and kicked shit out of her for it. she hasnt aproached me directly about it just snidey comments around my parents. As it looks i cant ever work on bikes at my own home ever again or until shes dies. I have a meeting with the local housing officer on thursday and am looking for any advice or laws i can use. As i am making no money out of these bikes(as far as they are aware) it is a personal hobby.
Any advice experiences welcomed. I have tried being civil with her but she seems to want all the cakes and eat them. Btw i stay in moray in scotland for any laws but i have looked through the tenants hand book and it says nothing about working on vehicles.

Edit. Forgot to mention she is also on the local housing commitee and she seems to have fast tracked things through, now to my mind that is abuse of power. I have had no warning what so ever.

I dont think she should be taking pictures of you when you are in your garden. I know if you install a cctv camera it cant overlook anyone else garden so i think she may be breaking the law.

Put up big fences so she cant be nosey.

If you know you are going to get banned working on anything altogether(which i cannot see) then you should get all your biker mates to come round and park in your back garden and have a noise contest

That'll wind her...

On a serious note my ex wife works for a housing company and ill have a word. Who is your tennancy with i.e new charter etc

Work on them on the road outside your house, see how she likes that.

In avoiding litigation of other sorts, I can wholeheartedly advise the keeping of 'concurrent records'. Get yourself a notebook and record the times and dates you are working on the bikes, possibly with a note of the type of work you are doing and if you were using power tools.

This means that any allegations being flung about can be easily refuted.

Might also be worth requesting a meeting with her, in writing, to try to work out an agreement with her for times when it would be acceptable for you to carry out routine maintainance on your vehicles. Given your description, she wont take you up on this offer.

All to your benefit, you can then show that she is being unreasonable and unwilling to reach an amicable compromise.

she sounds like she has nothing else better to do in her boring life but worry what you are at. been there myself. she sounds like the sort that would abuse her power also being on this comitee or that cause he is on this thig she is trying to put the wellies up you.

you on the dole? cause you said you didntmake money from it i wonder is she going to try and shop you in? jut to start some trouble so she can stick er head out the net curtains and have a smug grin.

my bf done the same as you and he fixed my bike mostthe time or one for his mates and the neighbour was the same and told are landlord, but never reported the young chavs on the scramblers making oise from early morn til late night. Rolling Eyes

Thanks for the advice folk. My meeting has been finalised for tomorow at 2.30 so im going to make a list of things and try and be reasononable with the guy. I dont suppose anyone knows if her taking picturers is a criminal offence? Or invasion of privacey.

I don't know, but it would be worth mentioning at the meeting that she's been doing it, you find it antisocial and it is causing you fear/alarm/distress*.

*Delete as applicable but do use one of these three key words as they are the ones used by councils when considering if something could be defined as 'antisocial' behaviour.

I used to recruit housing officers so have an understanding their duties and usual actions.

They will ask you to keep a record of your actions, I am your neighbour will have kept a diary as the complainant. There isn't really any way to fast track a complaint, but you may just be unlucky and have a super efficient HO - in which case you will be fine!
Their aim is to sustain your tenancy, and at all times find a compromise.

If you maintain your working hours as you have described then your noise levels will not exceed the legal thresholds.

Keep your cool, and keep a diary - Good Luck Thumbs Up

I also have a problem with my neighbour along the same lines as yours.

I have a large metal shed at the bottom of my garden where I work on my bikes and she suffers from shed envy as hers is an old wooden one that is rather rotten.

We have a shared path at the front of the house that she objects to me using as she claims it's hers. My half has a large tree at the pavement end of it so I have no choice but to use her half so she reported me to the council for driving bikes over her garden. It' a concrete slab path!

The council also claimed I was blocking a rear entrance fire escape, the rear access to my garden with a bike. One with a deadlock on it where they have recently changed the lock and refuse to give out the key! great fire escape. Wasn't my bike either but a neighbours. I couldn't get my bike down the back path due to a rabbit hutch blocking it.

I keep hold of the letters they send me as one day this will go to court and I will at that point sue them for harrassment.

Hmmm sound interesting sickpup. The fact is i am not realy causing any real disturbance at night and it appears it was just her complaining. She also has a nerve situation. I meen i have tried to be reasonable with her i cut my use of the shed and power tools down and she still complains even with a warning. So i mean i have tried my best by her and its not good enough so if i get told you can as long as i am not doing it late into the night she is gonna suffer Twisted Evil . And if not ill make her last of me being able to work in my garden one she wont forget.

Well a good result im allowed to work on my bikes or family bike. Im not allowed to sell and buy bike to work on at the house. But she isnt going to be happy when she sees my next bike turn up Laughing .

Never got a letter from the council it was all verbal because im a young peson supposadly(18). But my next bike to sort will be my sv then my zxr750 and whatever i decide to sort next out of my garage of doom Laughing .

Bah curtain twitchers are getting more power recently the government introduce lots of hotlines to betray your friends and family , ie how my mate in Plymouth got a £60 fine for putting out her bin bags early too early (can only be 4 hours before the binmen come) and she put them out by 8AM before wandering off to work.

Failing that get a massive sheet of blue tarpaulin and secure it across the whole garden so she cant see what you're doing under it. It'll piss her off soooo much, nosey people hate not being able to see what's going on.

have you got any other people that could say you aint be making noise or doing anything unreasonable? as long as you can show that you are not running a bussiness then you should be allowed to tinker with the bikes, failing that take the bike in the house!
