Right i just got a letter in from the DVLA saying i have to pay a £40 fine for failing to fill out a SORN form for my bike.

I sent them a letter just after the bike was stolen asking for a tax refund and a letter accompanying the refund sheet stating that the bike had been stolen. Do i actually have any grounds to contest the fine or do i have to pay up because some muppet at the DVLA didnt realise that as it was stolen i would no longer be riding it.

As you can imagine i'm quite a bit pissed off since money is tight enough due to having to replace the bike and repair my old one to try and recoup some of my money.

I once forgot to send a SORN statement in and they sent me a fine.
I wrote back a polite letter saying that I HAD sent the form and there appears to have been an error.
They were fine about it and revoked the fine immediately.

Even if they say no to you, nothing to lose.
And with clear grounds of your bike being stolen you should have no problem assuming the police were notified and you have a crime ref no. to quote.

I'd contest that on principle alone in a court of law,

with a police crime number as evidence you have a strong case,

remember the DVLA is a scummy government agency and NEVER admits liability , even when they are clearly wrong , its why finger prints are no longer admissible in court as evidence , ask Stinkwheel why.

You should be ok, even if they can do you for not sending off an official form, you informed them in writing that the bike was no longer in your possession. Simply write back to them, informing them of that (quoting any crime number you have) and then sit back and relax!

of course before sending them the original, save copy for your self and you can have them if you do ever need to go to court.I'd say it is an over sight on their part when you sent them the letter and refund their letter they may have got crossed in the post with your letter? maybe

definitely contest it, did they acknowledge your letter and send you a refund for the tax? How long ago did you write to them to them that the bike had been stolen?

Wrote to them end of may and enclosed the letter in the same envelope so as to avoid the risk of them getting seperated. Got my refund cheque through the post over a month ago and now they are trying to claim 2 months tax and £40 fine.

I'm sending a letter stating the facts as they stand and also including my police crime number for proof the bike was stolen and also stated the address the bike is at now (MOD base) saying they are welcome to go along to verify the details if they wish.

Shall see how things go and try and keep people posted incase anyone else has similar problems in the future.

Tell them to get fucked, their a wast of space, i remember i went through the same situation, them trying to blame me, because they are so inept and had not updated their records and id sold the bike, i sent the V5, sent 3 lletters also stating i was no longer the owner, and still got a court summons.

Was in the court room all of 5 mins, the DVLA didnt turn up, wasted my time and the judges time, and her words were " Fucking useless the DVLA" and i got offered the choice to claim loss of wages and transport costs, but im not greedy.

Just get on phone and rollock the fucking inept bastards.

Yeah, definately tell them to get knotted. If they have sent you a refund for the tax on the bike you had stolen, how can they say that you should have declared it 'off the road'? Thinking

They really are a bunch of inept idiots, they have acknowledged the fact that your bike will no longer be taxed by the fact that they gave you a refund. Thumbs Down DVLA Thumbs Down

off topic but DVLA are tossers, I would love to see their offices torched overnight! - and as they dont appear to keep any records for longer than 2 minutes, wouldnt actually matter if it destroyed records, paperwork etc, they havent a clue what they are doing anyway...

Sorry for rant but they "disappeared" my part 2 licence from many years ago, resulting in me having to take my test AGAIN nearly 20 years later!! TOSSERS!

Back on topic if you please....always send anything to DVLA having got a certified copy of it before sending and send it special delivery!

So you still have the bike registered to you? It was stolen recovered?

After a few days your numberplate goes on the Motor Insurance database, the same thing the police use to check if you have it.

Thats why you cant tax the bike online if you've only just got insurance.
