got pulled with pillion, bike is registered to him, i was riding, i sed i was him he said he was me, both on provisional licenses.

now we know we got caught out badly and gonna get screwed up big time, got 3 points and a £60 fine and producer. they know we swapped identities and we know we messed up big time, now i was wondering seeing as they know we lied and swapped, what will the full penalty be when it all comes out into the open, ill come off worse because bikes not reg'd to me, no insurance, shudnt have been carrying pillion and lying and saying i was him Sad

Have they said you will receive a summons? If you have had 3 points, fine and a producer - what were the 3 points for? I think in normal circumstances you dont get points if there is going to be more to follow. You get a summons and they do you for the full lot.

Drive other than in accordance with a license was the 3 points and fine. Never said anything about summons, its just, when we go to give the license in the faces won't match up if they saw mine in the car, which will jsut get the whole "they swapped faces" out in the open. I know they know they jsut never said anything.


Yea i expected those remarks, but thankyou r1NSR, atleast someone helps.
i learnt my lesson and well, forget even thinking about taking a mate "down the road" Evil or Very Mad


Also, they seemed to know who we was anyway, as I sat int he back of the car the radio said my name then his, so surely if they had said the reg it would have come up his only not mine? which i really dont know why, ive had a warning before but that was it, i still dont know how they would know it was me?

If they have offered you three points and a £60 fine. Say "Thankyou very much officer." It might help if you got down on your knees and licked his boots while you do so.

For driving outwith the terms of your licence and driving without insurance, you could have recieved a sizeable fine (well into three figures), a ban and up to 12 points

If they were in a really bad mood, they could have you up for perverting the course of justice which is a criminal offence. A bloke was Jailed in Cumbria recently for saying someone else was driving when he was caught on a speed camera.

That said, the copper fucked up too because he should have positively established your identity at the time of the offence, standard procedure.

Sounds like it is done and dusted to me on the basis that you have received the 3 points. So in effect you have been convicted of the offence. You cant be convicted again.

Riou let's get this straight.

You got pulled, you gave his name, he gave yours. They then gave you 3 points and a fine for carrying him on the back, but you gave his name so HE gets the points.

Is that right so far?

He just needs to produce he's papers at the station, they won't know. Pretty sure they would of said somthing if they thought you was lying.

Right, so HE has top produce HIS license and take the points. You have to decide between you who pays the fine. Simple.

Don't get all guilt-ridden and say you'll own up to it and save him the points because you won't . If you own up to being the rider you will get points/fined, but then HE will also get exactly the same points and fine for permitting you to ride it. There's no way out of it for him, but you seem to be home-free.

they knew we was lying because he got my DOB wrong lol and he did a check on the details he gave (my info) about 3 times. the last time he just sed "that will do for me" and sent me off

Whose name is written on the producer and who has the fixed penalty notice? You or him?

When you (or he) go(es) in to produce your (his) details, it will just be to some lady on the desk who won't have any idea what you (or he) looked like in the back of the plod car.

thank you dmahon, i was thinking it would jsut be "turn up, hand it over, pay the fine go home wait for license to come back" but you never know with plod Sad

EDIT: one ticket, to me the driver, the other copper sed he could have done my mate for aiding and abbetting because he knew he shouldn't have been on the back but he let that go, as with the exhaust it has a scorpion can on it and I was sure you was allowed anything aslong as its 14.6BHP but he seemed adament there was a speed restriction, but it was how we bought the bike so he said take it to a garage and get it checked out

They usually ask for some form of ID, be it a credit card or whatever. Ever since some footballer wriggled his way out of doing 120 on the M74 by saying they couldn't prove it was him driving (despite having been stopped).

Did they caution you? (ie. You have the right to remain silent etc.)

Did they say they were reporting you for consideration for prosecution?

What HAVE you got at the moment?

As above, if it's just a producer then it's highly unlikely you'll see the same person at the station. Do you have to use the local one or can you go to the next but one town(?).

If you've got a court apperance then you're in a shitty area...

Yea i got a caution, whole speech. They did ask for ID but I didn't have my wallet and he played dumb to it, they never said they were considering me for prosecution.


EDIT, as i gave his address its about 20 mile away from where we was, and he lives 10secs walk to a station so I said that one.

Now, that makes me think they were two local plod who don't know anything. A traffic officer would have arse-raped you on the spot.

What papers did they issue you with?

If you just got a HORT1, make sure you* take the documents down to the police station within the next 7 days. Make sure they are the docs for the person named on the chit.

Sounds like you MIGHT have gotten away with it, although you don't deserve to.

* EDIT: Make that whoever is named on the HORTy.
