Just realised I think I posted in wrong section, can someone move it, sorry.

Well, it is the second time I have crashed, just this time it was more serious. There is a small side street, one way in our town, which I was coming up after work 23:20. There were people walking in the middle of the road, drinking beer, I guess they heard and saw me coming as they all moved out onto the pavement. As I preceeded up the road, one of them jumped into the middle of the road, and did like a stupid dance thingy, then jumped back onto path as I proceeded further. As I was very close to coming past, one of them, a female decided to try and run in front of me to the other side, as soon as I read this and she entered the road, I pulled on the front brakes and the back slightyly, avoiding her was not an option. Anyways I hit her pretty much head on, and she came off and hit a parked car, and I came off and slid down the road and my bike spriralled off even further. I cant quite rember how it went but anyways there were numerous people with her who were shouting and screamign at me saying how I flew up there and drove at her )i was doing around the speed limit most of way up xant be exact as i was watcgin ahead, but rolled of thottle wen the idiot jumped in the road, it was a 30 btw) and an ambulance was called. The woman, literally I do not lie here ran staright out just as I was coming up to her, and stood no chance.

Meanwhile i received more abouse, and a few mins later a few people i knew came to me and sat with me, a few mins afetr that ambulance and cop car came screaming up. They attended her first then 1 came to me, just some light taking incurred, wher are you hurt etc? mainly my side and my wrist, from where i slid.

Anyways all the while the girl was screaming and i started getting panickky and shaking quite bad. I was left for several more minutes, to be fair it was like 10, just lying next to the kerb, they had to call another ambulance, as the girl went i the first, yet surely when it was radiosed through they would of said their were two casualties?

Anyways they put her in the back of the 1st ambulance, then they put me on a spinal board? or something and a neck brace/collar thing, loaded me on a stretcher and put me in the 2nd ambulance. The 1st one take off, meanwhile the police come in, and breath test me, and give me a producer, which i had to sign there? well it wasnt much of a sifnature, as i was still shaking.

Anyways we get to hospital and they dump me in a room for about 30mins come back see if i'm ok, then about another 30mins they finally take me off the spinal board, and check my back etc.. and my neck, it hurts so much being on that board witht the neck thing. Anyways i get out of hospital about 2:30 - 3:00 cant remember.

Get home and have a quick look at my bike Sad the whole front end is smashed up, the clocks are out of line, as is the steering, the screen frame and someother metal is bent backwards, my mirros are over the place, i hev smashed pretty much all the fairings up apart fro the tail. The crash mushroom, was ground down a hell of a lot, and is bent, which has alos snapped the bit it screws into on the frame, so i cant fit another one in. I think the whole thing is going to cost around 600+ easy.

The legal bit, i personally say she was in the wrong, yet i will admit to speeding to start, and this cannmot be excused, even tho i slowed to at least 30 or below by the time i hit the woman. My main worry is as there were at least 6 of them, they will probably all say the same, resulting in me getting screwed over. However if she claims liablity, and admits she was i the wrong, and considering she has homeinsurance or some other type, i get my repair bills paid for me.

The woman sustained a fractured wrist or am, alonmg with minor injuries, which i feel was quite lucky considering. If i had been going fast or deliberally at her, it would of been a lot lot worse.

Shocked Jeez Nathan! Sorry to hear that! Sounds nasty! I'm sorry, I can't help with the legal stuff, but I hope you'll be ok! Your poor bike! Crying or Very sad
And I've had donuts like that try to do the same to me - I once had a drunk girl grab my pillion and try to pull her off the back of my bike, resulting in a fairly hairy wobble!! Evil or Very Mad

Just had a thought: by any chance, did any of those who came and sat with you witness the crash? It's possible you could get them to be witness for you. I don't know, but possibly the fact that she and all her friends were drunk might just not help her case! Again I'm not sure - I hope someone can let you know for sure. It might just help if you had someone to corroborate your story!

Hey thanks. The road is well known to local residents as one often used for playing 'chicken', I guess you all understand this term Rolling Eyes

Well, whether she was playing 'chicken' (she lost) or was just being stupid, or as a result of being drunk it was a nasty experience. Especially when she was screaming and i was just lying about 10 meteres away helpless.

Just hope that she claims liability, so I am not bummed by the police and their crummt justice system and also that then i dont have to pay what will be a costly repair bill.

They might do, to be fair I should imagine. My main worry is there was no CCTV otherwise this would of proved the other guy, and the girl running infront of me. And also, I am not saying that's what she was doing, maybe a possibility?

Well whether or not she was playing chicken, she was still absolutely idiotic to jump out in front of a moving bike ffs!!! But I've seen it so many times - they're idiots for it in my town!! Rolling Eyes

But then it comes back to the fact she had people with her, I guess friends, who will probably back her if they decided to blame and sue me Thumbs Down or at least claim anything they can

Yeah that's always a possibility unfortunately - the way the world has gone these days - break a nail - oh sue - get as much compo as you can!! Rolling Eyes

I edited my first post - I don't know if you saw it, but did you have any witnesses yourself - like those who came to sit with you - did they see the crash?

No, none at all, Just her friends. Soem mates and others i knew came and sat with me about 3/4 mins after, all her friends just stayed with her, apart from 1 who cam eover shouting at me, as I lie next to the kerb Evil or Very Mad rvil git! I understand though for them staying with her, all the screaming and she must of been in shock.

Yeah well I guess they are going to side with her - she's their friend and they've just seen her get hit by a bike (and if they're full to the gills with drink too, they're definitely not going to stand back and say 'Ah well, you shouldn't have jumped out in front of him then, should you?!' Sad

I would think very carefully about this.

When asked how fast you were going, perhaps:
"I don't know. I was giving my full attention to the hazard on the road ahead, not looking at my speedo. You see, there were drunk people standing in the carriageway. " would be a more prudent answer.

Yeah, I was also very lucky. I only usually wear just my textile jacket going to work, wearing my thin work trousers. 7 miles each way. I am bad I know, and from now on will always be wearing the right gear. I had textiloe trousers and jacket on, The jacket has been chewed at wuite badly, will get a pic up 2moro. If I didnt have trousers I doubt I would have any skin left on my side and thigh.

And I was only wearing them as it was raining when I went to work. Funny how some things turn out.

Well Nathan, I must admit to not always wearing full gear either!! Embarassed I always wear jacket (textile) helmet and gloves, but don't usually wear the trousers unless I'm going on a long journey, or proper boots, just standard work ones! Certainly makes you think!

Only reason I know that is I was once told it as the standard answer you give a traffic cop when they stop you for speeding.

First question is almost always "How fast were you going there sonny Jim?" or similar.

If you say "I don't know.". They then say "So you weren't paying attention." and book you for a CD10.

So what you say is "I don't know, I was giving my full attention to the road ahead." and wait for THEM to tell you how fast you were going. It is usually nowhere near as fast as you thought which can make the diference between a fine and a ban, they sometimes don't know at all.

I know I've been stopped after doing WELL over 100mph but the cops had only got me for 98 and I got away with a fixed penalty. If I'd have said "Around 120mph", I doubt things would have gone so well.

No, they said they will be round in a few days. And as I have already said to insurance I was around 35, would that be wise? Surely then they could say, well then you were probably speeding to of hit her etc... You know what police are like..

I'm really not sure Nathan! You could always say after that you were in shock after your crash (which I'm sure is true anyway! I could almost see the shake in your hand with your OP!! Wink ) and you're actually not all that certain of your speed?
