Having recently passed my A2 I am hoping to move up to a bigger bike. Ideally within a few days but I'll keep shtum about that for a bit Wink

Anyway, that means I'll be selling my TZR125. I'm just wondering if anyone could advise me to the legalities of selling it and if I am held liable should anything happen to the buyer when they drive it home.

EG:

Is it my responsibility to make sure that the new buyer is correctly insured and has the correct license before I hand over the keys?

If they were to have a tragic accident on the way home and the fault was found to be with the bike, would I be held accountable? (Not that there is anything wrong with the bike of course Smile Just wondering).

Nah, just put sold as seen on the reciept(receipt), Once the bike is theirs its their responsibility. If its not Taxed, MOT'd or insured they shoud use a van or trailer, but I doubt the buyer will.

They buy the bike, you give them the new keepers slip from the V5 and fill the rest in and send it off to the DVLA. They get caught doing anything on their way home and it's nothing to do with you. It's the riders responsibility that the bike is roadworthy, not anyone elses.

If they buy it as sold as seen there is no comeback. As long as you have not misrepresented it, like clocking it or deliberately hiding a serious fault.
As far as test rides go, then you want to see their licence, check that they are insured, and be holding their cash or it is a no go. You cannot accept his girlfriend as collateral even though you may think it is a fair exchange. The cash is the most important but duty of care would come into place if they had an accident on a test ride.

sold as seen = buyer beware no come back ,

generally though I'd not sell nearing its MOT or tax date , since DVLA records may get confused and send YOU yes YOU the MOT slip and tax renewal.

just sold the dead cage, was on autotrader as "Cambelt failed, engine work needed."


Sold with a reciept stating "Sold as seen" (which was 9pm at night...). As soon as they sign the V5 then it's their responsibility. You just need to send off the V5 (that's a must as scammers can keep it and run up speeding tickets or not get tax/insurance etc. (happened to Mrs. K) under your name.), give the new owner the green slip, and you'll get a letter in about 2 weeks from the DVLA acknowledging the transferr of ownership.
