Yep, 2nd off in 3 months Crying or Very sad

Well here is what happened...i was tootling along behind about 3 cars and a bus, the bus incidicated to go to the bus stop, and it did stop but just randomly pulled out (while still having the left indi on)

While it pulled out, me and the over cars were in the process of overtaking it (bearing in mind we didnt know it was gonna pull out, obviously Rolling Eyes )..the 2 cars infront got past but the car infront of me braked sharp so i did to, but the thing was the road conditions were damp (it was just instinct...what does anyone do in them conditions?)

I came off and the bike slid into the car in front causing a little scuff about wheel height on the left handside on the rear, and a damaged exhaust (looking at the forks it is believable..i had like a gouge (sp) on the bottom of the fork leg near the axle.

The biatch has already had her car taken away by the insurance company (so that throws away the idea of paying her with cash and saving a years no claim) but there is quite extensive damage to my bike.....really bent crash bars, bent handlebars, bent clutch lever, bent footrests, broken mirror, damage to forks (just cosmetic, nothing that stops them from working)

But, my main question is can i claim off the bus people for my damage? Considering he is the one that pulled out and caused the accident.

Also, the police organised a recovery truck to take my bike away, and there is a standard £105 fee then VAT on top of that...but the thing that pissed me off is that the recovery place is literally around the corner, less than 1 km. Also the police didn't bother to ask me if i had roadsider cover (which i do, i have full AA cover)..damn bastards!

Ahh well, im orrite, told work im crippled so got rest of the week off Very Happy

And both paramedics were hot so thats a bonus Very Happy

No legal expert but I'd say if you had a witness to testify that the bus pulled out with its left indicator on then the bus company has to pay out.

Oh i forgot to add that there are some plastic coveres that clip around the frame just behind the headstock and under the tank and above the engine (hard to explain)

There was some hot college bird waiting for the bus that came to rescue me and she said it was the buses fault, as did some other people at the bus stop.

But the only thing is, i don't have any contact infomation for them

Glad that you're ok - two offs in such a short time is bad luck indeed.

To be honest I think it's going to be hard to place the blame on the bus company without witnesses. I know it's hard to remember at the time because other things are on your mind but you need to make sure you take notes of any witnesses around the incident that agree to help you.

In a word...no, if the car in front had not stopped as quick and carried on you would have been ok also. But it did and you panic braked and went into the back of it. Busses do it all the time, expect the unexpected.

Basically you ride to the conditions, slower, smoother and leave much more room in between you and the vehicle in front...."just in case".

Luckily you were not hurt and you can put it down to experience.

If you hit the back of someone, it's very difficult to get out of paying up. The idea is you should have left enough room between him and you to stop in. But good luck anyway.

As for paying yourself, it's amazing how much a small amount of damage amounts to. I was hit on the rear bumper 2 years ago - small gouge, about 5cm. The other driver had a company car - with company insurance. Anyway - new bumper (they don't repair, they replace), spray and 3 days of hire car didn't give much change from £1000.

The AA/RAC etc. charge for recovery after an accident. If you have comprehensive cover, your insurance company will pick up the tab.

Hmm, thanks guys.....

I don't think i was riding to close. What happened was i came off and the bike just carried on into the back of the car..i didn't actually ride into the back of it.

Anyway, i don't think i'll get out of it now but heyho...shit happens, get rest of the week off work and the paramedics were hot so that made my day Smile

Finglonga - I don't think you can say its down to experience...i'm only a learner Razz

Confused it's an experience.
i had two offs in one day when i was a learner, the road was wet. i jammed on the front too hard, slid down road. both fortunately at around 10mph. it's a learning experience ie: you learn from it and don't make the mistake after it.

I did the same thing, in the same place, at the same time, for 3 days running. Which was catching a white island in the wet! Rolling Eyes


As for advice. I would not have been soo close to the car in front whilst overtaking. If I was, I would have simply flowed around the car infront, that is if there was enough room to do so. If there wasnt I would have 'aimed' for the actual bus-stop-bay-thing, mainly so I would have had more run-off room.

I couldn't really aim for the bus stop, there was a bus in the way (well there was until it pulled out)

My first off on this bike was on a roundabout and that roundabout is named THE roundabout...just like the corner where i came off my moped is THE corner. Very Happy

So i now totally avoid that corner and that roundabout...there are plenty different ways, and avoiding that roundabout is actually quicker because it bypasses loads of traffic Wink

With all due respect, not as stupid as it sounds, your going to get stuffed by the car drivers insurance whichever way you look at it. At least stick a notice to the bus stop asking people to phone you if they witnessed the accident. If you can prove that the bus driver pulled out without indicating then all costs will eventually end up with the bus company. Its not the immediate cost that matters, its the effect on your insurance, the opinion of the car driver, and the fact that the bus driver, who is, possibly, responsible for the safety of several hundred people each each day, is incapable of basic observation. The second you get a reliable witness report the bus to the police, you only need the route and the time, even they should be able to work out who was driving.

Matt, bit of a rough ride you've had ( dohh soz Rolling Eyes )
The cops should have asked re recovery, however, if it was in a dangerous position on the road and you were being tended to by the gay paramedics then they acted as guided by 'HO'.

As for who's pay out..... your insurance initially, if you could prove what happened then the bus company should cough up OR go 50/50 on the damage.
The fact that your bike slid into the stationary car pretty much negates the fact you were following too close, YOU stopped, the bike didn't.

You WILL hopefully learn to read the road much better with experience, as previously stated, " expect the unexpected" with buses that could be anything.

Well i know the ambulance got their call at 9:09 so im guessing it was between 9-9:05.......

I know what the bus number was (Well the hot bird told mentioned it to someone else but i overheard Very Happy)

I'd rather not put my phone number up in that bus stop though, theres shit loads of chavs and no gooders hang around near there....i'll end up getting stalked lmao!

Obviously paying your excess, the addition to next years insurance, all the other costs incured, AND letting them get away with it is worth not buying a cheap pay as you go sim and listening to messages from some idiots with more money than sense Rolling Eyes

You could go to the bus stop tomorrow at around the same time as the accident and ask, humans tend to be creatures of habit.

At least set fire to a couple of their buses to ensure they are write offs and maim the driver to make it fair, its what, possibly, could have happened to you.

Aye, thats an idea markie....The bus that goes to that bustop actually goes from (or through) dewsbury bus station (i live in dewsbury Razz ) so i may just jump on the bus.....not as though i can ride it...hes a list of the damage...

bent handlebars (not just bent but twisted to)
bent clutch leaver
bent footrest
totally ebliterated right mirror
totally mangled screen (doesnt really effect riding as it was a bolt on...not as though its on a fairing or anything)
broken plastics
damaged forks (just cosmetic on the bits that the tubes slide into)
about 2 litres of fuel lost Razz

I am only replacing the bits that make it unrideable atm (all i can afford)

which are handlebars, clutch leaver and mirror....i bent back the footrest (just like i did with the overside when i had my first off Razz )

The tyres on it are shocking, they are 'kenda' (even our forklift and wheel barrow at work has kenda tyres Rolling Eyes )...so i was wondering if anyone knew of some decent tyres that fit on mine, the sizes are

90/90 - 18
120/90 - 17

I will have to double check that tomorrow when its light because the suzuki site says my rear is a 130 and front a 110...but i know for definate they are 120 and 90......i could fit a 130 on the back but i don't think a 110 would fit on the front.

Oh btw, they are tubed.

Try Moto-Tyres for cheap tyres. I had a new rear for my Marauder from there, I think it cost me a grand total of £35. Thumbs Up

Your a star THCi..i'll have a look at some tyres.

After just getting my quad fixed (knackered gearbox)....i am about to get some pictures of my bike (insurance company also want some to)

The women that my bike slid into (well slid into her car, not her lol) has told us over the phone what her statement was, and it is practically exactly the same as mine (as in saying that my bike SLID into her car, and not that i crashed into her....also she also backed up me by saying that the bus still had his left indi on when he pulled out...looks like we might be getting somewhere! Smile

i have a front tyre adn wheel if you want it? its 90/90 - 16 its pirelli. got fair bit of mileage left in it. not sure how much diference that would make.

I just got the actualy sizes off my tyres and they are....

Rear: 120/80 - 16
Front: 90/90 - 18

So i believe that tyre of yours won't fit mike...thanks for the offer though! Smile

Edit - I got some pics of the damage but i did then on high quality and high res....so it would take about 18 years for this page to load if i uploaded (ie the first pic is 2.8mb Razz )

So if anyone wants to see them...PM me your email addy and i'll get them sent to you Smile

Did you tell them?

FYI, as said above, the AA are funny about recovery from accidents. It has to be a 'no fault' accident (that's not your fault). Maybe the police know this. However, doesn't explain fully as I'm told the RAC will recover if you're in an accident regardless of fault.

Just some thoughts.

Aparently the AA will recover you after an accident under any circumstances.

If you have fully comp insurance then the AA pass on the bill to your insurers (or to you, then you pass it on to your insurers)

But if you only have TPFT or just TP then the AA will cover the cost (Aslong as your an AA member with roadside cover and recovery)

I didn't get chance to tell them i had AA cover, PC Plod just walked into the ambulance and said 'i am going to organise recovery of your motorcycle *insert loads of shite here* and it will be sorted out later' or something along those lines.....but while your strapped to a spinal board, with a neck brace and a headsupport thing....you cannot move anything and all you can see is down the paramedics top and a flurescent tube...bit hard to have a convosation with someone....also after you just got crippled its a bit hard to do anything.

But still, i wanted to get up and have a cig but the damn bitches wouldnt let me Sad

I really haven't enjoyed hearing this recovery scam the police have going. It leaves a very unpleasant taste in the mouth. It's sounds as crooked as wheel clamping operations.

Yep, really pisses me off.

When my dad came from work, he came straight to the hospital (as any dad would do)..but if he had gone the other way into huddersfield then he would of been able to stop and tell them not to recover it and call the AA.

Ahh well, i have tried to resize them pics (from 3mb, to roughly 1mb Shocked ) so i'll see if lets me upload them.
