If you bought a bike by private sale and then find that it hoppes out of
6th gear and you have only done 5 miles.Then the seller says it was ok
when i sold to you.Is there any thing that can be done to get a refund
or the price to fix it.

The seller must of been a mug to re-fund the money then.


My re-fund policy is quite simple "Not my problem, now fu*k off" have only once had to tell a buyer of one of my bikes who came back this because l sold them a un-finished project bike that needed a lot of work and when they reilzed that they knew fu*k all about mechanics after being told by my self that the work had to be done by someonce who had a basic understanding they thought they could change there mind a week later. If you didn't have a test-ride and he didn't mention the worn gear dogs, then he's deceived you and you should go for some kind of compensation.

If you did test-ride the bike but didn't notice the worn gear dogs, I'd say he allowed you a chance to test the bike fully and you're out in the cold.

The reality is it was a private sale so if he don't want to play you're not going to get anything back by ordinary means.

Well if they don't refund I recommend driving a land-rover through their front wall, hoping over the bonnet and threaten to smash there legs with a 14lb sledge. Not that I've ever done that over a bike of course.

Shame you just filled your own address in on the log book. Nothing better than a bit of vigilante justice as long as they can't turn it back on you.

You're not likely to get anywhere complaining the nice way, if they rode the bike regularly there's no way they didn't know.

i would had checked the bike out 1st tho. when i swaped my dna for sunbears nsr, we both test road each other bikes before we did the swap and i was happy with the bike and he was happy with the bike. 3 days later the engine goes
on the nsr so it needed a new engine.
when u buy like a bike or car is like sold as seen.
i just bought my cbr 400 and i didnt not test ride it and i still aint riden it yet but i should but i aint Laughing
wot im trying to say is next time test the bike or car before u buy it.

wot bike is it anyway? if its a like a 50-125cc might be easy/cheap to repair

Right he is stuffed.you dont do that on a friend that has helped you out
and the friend can bring hell to you.Must be drugs i cants think of any other thing.and i dont know if i want to go after someone for the money

If you turned up at my door 'with the boys' a week after buying a bike from me, I'd tell you to get lost. If you gave me a call to ask if the bike had a history of that problem and asked if I could give any tips, then I might help you out. You're not entitled to anything, but be nice and you might get something.

I'd forget about it, fix the problem, and remember to properly check a bike before buying in future.

Sorry, but if you dont test ride the bike, and make sure its working, then its your problem. I mean you dont give your cash until your 100% happy with the bike, and from that moment on you release the seller of any obligation to you...

He sold you a clanger! and he knew it. At least try and get your money back. Make sure you fall out with him anyway if you get nothing. More than likely he needed the money for drugs and was looking someon to off load it to quick, he wont have the money anymore. Shame it was you though.

From a legal standpoint, a private seller can only be taken to task if he has mis-represented any details in an advert - e.g. if the advert says 'registered in 1999' and it turns out to be regd in 1998.

Private sellers will often absolve themselves of any comeback by asking the buyer to sign a receipt stating 'sold as tested with all faults'. They are under no obligation to reveal any faults, but are committing an offence (if witnessed!) if you specifically ask 'is the gearbox sound' and they reply 'yes' when it isn't.

From a non-legal standpoint, others have indicated possible avenues of attack.... Twisted Evil

Dragonfly, so usefull as always.

Look mate, you should have tested this before you paid the money.
In nearly every bike buying guide it says to give the bike welly in every gear to make sure it doesn't jump out etc.

If it bothers you that much stick it on eBay as it is, probably get your money back.
