evening everyone, didn't know where to stick this so posted here

i need a spot of advice with a problem i am having on FleaBay

basically a few months ago (3) i bought a laptop HDD (tested and working by seller) it was for me mum as part of an upgrade, as the laptop was being used for business still i couldn't fit the new HDD, last week i got round to it. fitted the HDD and it worked fine for a day then just gave up the ghost. It would seem the reader/writer head has come loose as somthing rattles.... anyway the HDD is obviously buggered, i have honestly done nothing to infulence this. The seller is infact an esablished shop that sells over Ebay as well. i have spoke to them and they are refusing point blank to refund or replace (which is what i want) i can send the item back at my cost for them to repair (also at my cost)
so really... legally where do i stand?? i have genuinly bought a HDD for £40 and didn't get round to using it for a while.

it has made me learn NEVER to buy electronics from flebay again, there are too many scamming ass-holes Evil or Very Mad

Basically, how does he know you're not trying to scam him? You could have used it solidly for three months, dropped it a few times and broken it, now be asking for it to be sorted.

Should always check goods when you recieve them.

Legally, I doubt you have any come-back.

Suspect if you did the same with a 'normal' non-ebay shop they would be very iffy about sorting it as well.

3 months is a long time to wait to try something out. How does the shop know that you haven't used it for that period, dropped the laptop and now are trying to scam them for a freebie? You might have had a chance if you tried it straight away, but I certainly wouldn't give a refund after 3 months.

3 months is fine , if you are worried get a company refurb those have 6-12 months on them (for a higher price per unit of course),

but then again consumer electronics all have chips in them that autodestruct the day after the warranty expires.

There is sales of goods law (that's rarely used, but it is there) that goods have to be a servicable quality for a reasonable length of time. That means for stuff like washing machines it's something like 3 (or maybe 5) years. You can go to the seller (as that's who your contract is with) and get replacement/fixed if failed in that time.

I know this makes stuff like extended warranties a bit redundant but, like I said, the protection is there.

However, only really applies to new stuff so if your drive was used/2nd hand then it's down to the discretion/honesty of the seller. In which case, apart from leaving negative feedback/updating the feedback on eBay, it sounds like this is just something to put down to experience.

That said I do know some 5.25" hard drives come with a 'lifetime' warranty from the makers. Now the cynic in me says that's for the life of the drive and when it fails, tough. However, might be worth checking that angle. Just a thought.

FWIW bought 4 laptop drives from eBay. 2 are still ok, one's started to make hell of a noise but appears to work and one I couldn't get working at all. Like I said, put down to experience.

thanks guys, cheers for the help, i understand where your comming from about thye 3 month thing and its fair play, i just wish i could have tested the part as i am now £40 down in pocket with a HDD thats a paperweight Sad just pissed off about it thats all Middle Finger
