Hi all,

I was riding along the A3 to heading to London recently, and knowing I can go through the cameras in the 50 limit at just below 60 all was going well. Just before Wandsworth the road goes from a 50 to what I thought was a 30. Knowing the camera is there, I slow down to just under 40 as I usually do. A bad thing to do actually as I'm supposed to be watching the road, not my speedo, but heh ho, how else am I going to be sure of my speed?

Anyway the camera flashed. Oh well , I thought. Didn't get away with it that time. Pay the fine when it comes through and get the 3 points. No big deal.

What pisses me off is I got the NIP today. It states that I was doing 50 in a 40!!

I KNOW I was doing 40 (by my speedo) I was looking at it as I went through the camera. As I said I thought it was a 30, but if they say it's a 40 then I should appeal as although I thought I was speeding I actually wasn't.

Question is, how do I prove I was going 40?

Also, the bike is registered to my company and the NIP came through to my company name. Is it not a violation of my human rights for me to incriminate myself? How did that guy on the news get on recently with the human rights issue?

I'm guessing this is the bit just before the Robin Hood roundabout where the signs are crap.

You don't fill n the NIP the company does and nominates you.

If you were flashed by a Gatso, your speed is actually determined by how far along the 'ruler' road markings you travelled in the time between the two flashes, NOT by the radar readout on the camera.

It is not unheard of for them to send out the fine on the basis of a spurious radar reading without having checked the photos properly.

If this is truly the case, your innocence will be proved by the evidence supplied by the Gatso itself. What you need is the photos, I'm not sure how you go about getting them.

Either that or you were going faster than you thought or your speedo is overreading. The photos are the key though, they will show your true speed.

I suppose if you are utterly convinced you were doing the speed limit, take it to court. They will examine the photos properly themselves and will have to provide you with a copy of them. You can be sure that if you actually were doing 40mph, they will drop the case like a hot potato, just as you can be sure that if you were actually doing 50mph, they will do you up the arse.

Sickpup, Its the stretch of road after the underpass where the road goes from 3 lanes into single lane, that's why I thought it was a 30. Also it's my company, as in I have to say who was riding the bike.

Stinkwheel, if I appeal and am proved guilty, won't I have to pay costs etc.? I'll always only get 3 points though won't I?

By my speedo I KNOW I was doing 40, and I don't trigger 50 limit cameras at just below 60 so the speedo can't be that far out. Not a good ground for proving speedo accuracy in court though!

If this is the case it wont get to court. The case will be dropped due to 'A lack of evidence' Smile - Read some reporter in one of the mags did this recently. Convinced they were innocent, so let the bastards take it to court. Trouble is if you make a mistake, and you were speeding you'll end up paying alot more for it...

This of course assumes that the length of time between the flashes is the same as the length of time they say was between the flashes... Wink

Hi mate I go along the A3 every day on my way to work. I got flashed going towards london from the camera just after toworth tower going 50, in a 50. That was about a month ago now and I have not heard anything since. All those cameras along the a3 are altra sensitive, i would appeal and get the fuckers to work it out properly

In all honesty, out of all the speed measuring devices out there, the Gatso cameras are very accurate. If they got you, you are screwed and have very little room to argue.

The question is did it actually get him or have they sent out an NIP on the basis of the radar reading alone without referring to the distance travelled on the pictures which doesn't mean squat?

I see a classic example of this kind of thing when I go up the A69. The cameras on that road trigger with traffic on the other side of the road. Someone could be driving past the camera at well under the speed limit, if I go honking past in the other direction at three figure speeds, it flashes them (and I'm well past the camera before it actually takes the picture). In that case the radar display would show the car doing 110mph while the road markings show it doing 50mph.

I have triggered them a couple of times at well under the limit. Both times on the RS125 (mmmm, well under the limited indicated by the speedo probably means I was barely moving). Nothing coming the other way. Suspect it is something to do with some deflection of the radar signiature on that bike.

While the terms of the homologation for the speed cameras does require them to double check the readings they often do not bother. However the radar reading is the primary evidence and the markings on the road are just there to double check.

Ask for the phots, they are your only evidence, in fact they are about the only evidence for either side.

Forget trying to prove the GATSO was not calibrated, it will have all the paper work by the time you get to court, no worries about that Wink

AS mentioned, try pepipoo, they will be able to advise you on what the gaps mean on the photo, each white line indicates X distance, each white lince corssed between photos = XX MPH.

GATSOs have been known to get it wrong, the photos usually prove this, all you can do is ask and go to court.

Going to court will not cost you a lot more, probably an extra 30 quid in costs if you turn up in a suit and look polite all the time, assuming you are guilty, if innocent you can ask for costs, including your day lost wages for day.

pepipoo will have a list of Lawyers in your area, if you are convinced you are correct, ask for the phots and get in touch with a Lawyer off the pepipoo site, best chance you've got lies that way.

i was caught by a mobile gatso many year ago now. Before i filled in the form and returned it, i made an appointment to view the photo to clarify who was driving. When i went to police HQ to view the photo, it was a hi def front end shot which clearly showed it was me, and more to the point, it had all the relevant etails on it.

I suggest you view the photo before you do anything at all. CHeck out the marks, whoever shows you the picture should explain it to you. This will help you decide what to fill in.

I remember asking to see the photo on a previous NIP, and they told me if I want to see the photo then I have to let it go to court.

I'm going to look into this though.

Strictly speaking they don't have to let you have the photo, but the ACPO guidelines suggest that they should let you have it.

Some areas will refuse to show the picture until the last possible moment before court, trying to bulley you into just paying up with threats of higher fines / court fees.

i never had any resistance about viewing the photo. Best thing to say is your company is not sure who was driving the vehicle, so therefore you can not presume or incriminate any one person. (is was a company car right?) surely this alone would allow you to see it, or wouldnt it be witholding evidence type of thing on their part.

No need to give you any evidence until a short time before the court case (couple of weeks or so). As if the case goes to court the scamera partnership do not get their money from it it is in there interests to bully you into paying up (although this might be changing with the way their funding is changing).
