well about 5 months ago i overtook my friend and got sent on a driver training course, they then failed to send me a letter about payment so im now facing due care and attention, ive just recieved a summons.


well 3 weeks ago i got done for speeding 40 in 30, blah blah, i was going to take the points and fight the first one.


what sort of thing can i get for due care? i was going to plead guilty and appear in court, as my friend wasnt from around here and he moved over to let me past, as i went past i shouted" its down here" momentry laps of concentration of wich i regret fully.

i just dont want to get banned, as im still only aloud 6 points, if i get banned its my whole education over, im in college hoping for uni, my dad cant drive me hes disabled and i cant afford taxi's and busses everyday.

abit of advice would be great.

I have a CD10 as well and was only allowed 6 points at the time as well. Due to the nature of getting a CD10 I pleaded guilty and explained to the court how important my licence is to me.

Basically I said that if I was banned I would lose the 3 jobs I had at the time and fail the uni course I was doing, which the 3 jobs were paying for (a small white lie but hey).

I got 5 points, £90 fine and no ban.

If this is you first offence and you show how sorry you are then you shouldn't get banned.

Sorry to hear about this Steve.

I have heard in the past about people going to court with all that they had in defence and it seemed to work.
You’re in a situation which could mean a snow balling effect could get you into some serious shit if you are banned, you need to have a word with the people on Pepipoo and ask them about making up some bullshit about your uni course and your lack of transportation.
As said above, if it does work they will most probably put you on the boarder line of a ban, so if that 40 in a 30 goes through, you’re fucked.

Tell them what you told us in court. You genuinely need your transport. Some courts might be more linient for your case. But you will have to promise in future that you will watch your speed.

How old are you and where do you live?
You can almost certainly claim for free bus travel/taxis from the council/LEA.

That's a moot point if he can wangle his way out of a ban.

I'd take it to court Steve, firstly explain that you never received the letter for the safety day and this wasn't your fault, and that you need your transport. If you can prove that the loss of your licence will greatly affect your livelihood, they don't ban you.

my dad said plead guilty buy letter and not say anything about me getting done for speeding, but thats one of my major defences, saying i cant have anymore, would it be wize to tell them i have 3 points pending and i cant stand another?

you wont get banned..if you get 6 points you lose your licence.

totally different,you can rebook your test straightaway and get your licence back,not quite as bad as a ban. Wink

Not a ban, more of a re-take of your test, if you reach 6 points.

You will revert to learner basis straight away.

So there's nothing stopping you doing CBT and L-plates for a while.

You'll have to do theory as well.

One good thing, there's never much delay on bike tests, shouldn't be too long before you back on the road.

Good luck, my mates neighbour got flashed by same camera twice in a day and hit the magical 6.

Its a bit unfair, I was relieved when the wife made it 2 years after passing.

Didn't apply when I was younger.

Are you within your first 2 years of holding a licence? (sounds like you are cos the 6 points is the issue here). IIRC your licence is 'withdrawn' for getting 6 points which is treated differently than a ban. I think you can retake your theory & practical tests again as soon as you like, and if you are successful you can get your licence back straightaway. I;m fairly sure that's what happened to a mate of mine (he was in a car but it's the same as far as i know.

Don't discount what bazza said. If you truely need your licence /that/ badly, then maybe you should have had more respect for speed limits.

He's not flaming you or whatever, it's true I'm afraid mate.

I think you're allowed 6 points, but no more, can anyone confirm that? So you can have 6 points but not 7.

3 points for a CD10 is realistic, and 3 points for the speeding.
I'd go to court for the due care, suited up etc, explain the situation, explain the speeding, explain that it's really effected you, and that it's really calmed you down as you /really/ /really/ need your licence.

They might give you 2 points and a bigger fine or something.

Or they might revoke your licence, but worst case, you hire a 125 for a bit, and retake your test. No real biggie.

In the first 2 years it is a 6 point limit before your licence is revoked. Nothing to stop you going out and doing your cbt the day your licence is revoked and going back on the road as a learner. However you will still have all the points you got. Exception to this would be if you got over 12 points (irrespective of the 6 point limit) when you will be banned.

waiting for my licence to come (hopefully tomorow) to go in and ask if i can take the 3 points for the speeding (if i cant) then hopefully go and fight the other,
then use the facts i have, that since the incedent i have calmed down alot, use my bike less, i dont go out just for a ride anymore, just use it to get my places to lower the risk of me getting done for somthing, im hopefully going to uni next year, im still in college and need it for transport, also work part time at the duke hotel and need it for then, it will aslo effect my partners lifestyle as i pick her up from work daily.

im very sorry for it and i can promise that nothing will happen like this again (i hope)
