Just taking this taxi driver to the cleaners...
Nipped into a shop round the corner from work on my way back from lunch. Said Hi to a girl I work with who was just leaving.
Ten seconds later she runs in and says get here now. I go outside. Bike is on it's side, taxi driver who was parked infront of me stood there looking gormless...
"Pick it up then" - he says. Oh, right ok. No shit?
So i pick it up. (In retrospect i wish i'd have picked it up too far and pushed it over onto it's other side.)
Anyway, he's like "Nah no damage there., you must have been parked REALLY close!" Jumps back in his cab and starts making movements to get going.
"Fuck this" I thought, got my phone out and took his reg. He brakes. Reverses. "Err mate before you start taking pictures and my details, I saw no damage there."... Drives off. What the fuck?
I stand there confused as to what just happened, all this lasted less than a minute. A guy taps me on the shoulder and says he saw it all. Gave me his number. Good show, independant witness.
Went back into the shop and ask if they have CCTV outside... Yes they do. They checked it. Whole thing was recorded, clear as day. Purfect.
Been onto the police, have my reference, and my insurance. Need to go get a quote for fixing it.
So, ALL the damage on the left hand side (Nope, sorry, never seen those scuffs before)... New fairings, coming to what... £600 odd? Plus labour? Good.

Edit: Just looked at the costs of all new original parts:
Driver Saddle, black:£61.29
Silencer/End Can: £171.94
Left hand fairing: £256.94
Indicator unit: £6.66
Clutch Lever: £8.61
LH Rearview mirror: £29.41
Rear Fairing: £122.95
Kickstand: £23.70
I assume it's okay for me to be proud and want new original parts instead of having the others "fixed"?

Well, he can be done for leaving the scene without providing his details.
In retrospect, leaving the bike on it's side and blocking him until he gave you his details would have been good. Then as he knocked it over, he could pick it up... ..
also, have no qualms about getting it "properly" fixed by a main line dealership. After all, why should you have to suffer with cheap after-market parts, it should be a like for like repair job...

its easy to say "you should have done this and that" but when it happens you think on your feet, but it'd have been a shame if you put your back out while lifting the bike on your own. put you off work for a few weeks, and it caused you and your missus deep emotional trauma and you would have to sue him for every penny. then spend all the money on a hired goon to break his legs every 6 months or so till the cash has run out oh and you are perfectly right to have the bike repaired by a main dealer using genuine parts, even it's just a slight scratch on the fork leg, fairing etc. it needs replacing with new. |

Dirty bast*rd. He showed no consideration or concern for any damage he might have caused and didn't even seem to give a hoot that he had damaged it at all.
It's your duty to press for a "leaving the scene of an accident" with the cops and also have him for every penny possible. I doubt it's actually possible to knock a bike over without causing SOME kind of damage so he's dreaming if he thinks he can get away with just claiming he saw none. ____________________ a.k.a 'Geri'

personally i would have dragged him from his car and arrested him for trying to leave the scene of an accident, failure to give details and anything else i could think of at the time. ok im a special constable but citizens of any kind can arrest you just need the offence to have happened. Section 3 criminal law act for the force used and your back is covered.
as thart didnt happen, take him to the cleaners, hopefully its registered to the guy, and he has insurance. If not pester the police, find out who is dealing, get a viper screening of the driver if he says it wasnt him, that will confirm. Looks open and shut really, easy detection every one is a winner. hopefully you wont get a lard backsided copper who hates bikes...

Just an update on this...
The actual owner of the Taxi turned up at my house after recieving the letter from his insurance... this guy wasn't the driver, this is the guy that actually pays the insurance.
He was sound about it, was unbiased towards his driver and wanted to get it settled.
He took a look at the damage.
I told him i'd been knocked down £200 on the offer I had on my bike whilst it was for sale, so £200 minimum.
He came back later with the driver, had another look at the damage, they clocked that alot of it was already there, but alas... they were fucked anyway and ended up coughing up the £200.
Problem settled.

Sorry to say, but you could and should have taken them for a lot more than the £200.
You have a witness (assuming he's good for his word) and CCTV evidence of the incident.
Assuming the existing damage to your bike wasn't visible in the CCTV footage, you could have really taken them to the proverbial cleaners.
Whilst you may have 200 quid in your pocket now, had you gone through the correct channels i feel you could have got a whole lot more.
Having accepted their 'settlement' i don't think you have a leg to stand on.
Don't wish to seem harsh, but i think you've just been had.

Yeahh I agree about citizens arrest.
The was an article in the mail on saturday, when a former policeman ran after a mugger and caught her.
Guess who ended up in Court, yup the ex copper.
oh the mugger got off with a £50 fixed fine.
The ex copper was cleared in court, but this was like 6 months later.
It is the society we live in. I wouldn't involve the police, I've not yet had a good experience of them. ie reporting car damage, reporting wifes purse nicked on 2 occasions, handing in a purse that I'd found (i was treated like some criminal and was rude to) and when my mate was assaulted and they refused to do anything because his attacker was Asian and the said it would be come a race incident. Eh? He was the victim of an unprovoked attack.
When I was ran off the road on my bike, I didn't even bother reporting it, because they'd have done nothing.
Did you watch bbc last night, when the reporter was phoning the police about a pedophile hanging around very young children. Yup you guessed they did nothing. Ohh he phoned twice, nothing, zero.
Only when he phoned up at a later point and said I am a Panorama journalist did they turn up. |
