Hi all
Ive got a bit of a problem with Philip Youles and could do with some advice.
A couple of weeks ago my bike began redlining as soon as it was turned on, so what with it being under warranty i rang up derbi who referred me to Philip Youles as th eclsoest dealer.
Youles then arranged to collect the bike, which they did on time and everything, and sort it under warranty for a fee of £47 for picking up an delivering the bike.
They rang me today to say it had been sorted and delivered to the manchester store. So off i pop after work to pick up the bike.
Get there, starts first time, everything seems fine.
I go to pull outta the carpark at the end of the road, as as im waiting to turn it cuts out. STart it up again, rev the nuts off it for a couple o mins to get things warmed up and head off. 200 meters down the road at the traffic lights, it cuts out again. Same story another few hundred meters down cheetam hill road, but this tim eit does it at 6k revs while im driving. I pull over and try starting it again several time but it revs for a little while then dies again. did this a few times untill the battery died, then bumped it and the same story, died while at semi high revvs.
Really pissed at this point i push the thing back 1/2 mile back to youles and complain it aint right.
A guy comes out takes it for a test run after giving it a good rev so t MUST be up to temp by now. He goes out for 4 miles or so then comes back and basically says "yeah well to be honest it aint 100% right, but we shouldnt have fixed it under warranty cos we didnt sell you the bike and therefore they were not looking at this new problem". He reccomend I change the spark plug, take it home and see how it goes
Now this cutting out issue wasNEVER there before i took the bike to him.
Obviously i told him that i asnt happy but he basically re-itterated that he wasnt ding any more work on it cos hed loose money.
I drove the bike home down the east lancs, and it doesnt fell 100%, its like theres little stutters at certain points in the rev range although i managed to get it home without any more cutouts.
Now WTF do i do here. Do i change the plug and see how it goes or start trying to make a big fooking stink over it and get them to sort it, cos this guy was adament that he wasnt doing any more work under warranty on it.
Does he have a legal obligation to sort it? and basically where do i stand.
All advice greatly received.

ring up derbi, tell them you want to be refunded the money you paid for the shitty service, and tell them you want the peice of shit fixed at no charge to yourself, or all the money back from the purchase of the bike. you shouldnt have any problems with a new bike and tell them that,
as for those phillip youles bastards they'll be charging derby for the " work" they did, it shouldnt even involve you at all. they should be dealing directly with derby and should do the job correctly, the fact that they havnt, is reason for you to call derby and tell them that they are getting ripped off by them,

PY are a bunch of rip off merchants who went on my do not recommend positively de-recommend them ,
try the "not fit for purpose defence"
