the tyres didnt have anything todo with the accident (tbh they were borderline and arguabley legal, but thats a different matter), it was a misjudgment on my part. something a set of the worlds most expensive rubber couldnt fix.
but yeah,,,im pretty gutted.  |

Well, even if there was such an offence as 'aiding and abbeting riding without a helmet" (which I strongly doubt). How the hell can you aid and abbet an offence that was thrown out of court? In short, they haven't proven the offence took place, so how can they possibly prove you aided and abetted it?
The big one is dangerous driving though. I can't remember the circumstances behind it, but this is a criminal offence, it is possible to be jailed. Remember they need to prove this 'beyond reasonable doubt". On the plus side, you should qualify for legal aid (I think).
They sometimes guff up here because without due care and attention is a civil offence and only requires a 'balance of probability'. The greater burden of proof can lead to you getting away scot free despite fairly good evidence. That said, if they have you bang to rights, you might be better to go for a reduction to DCA. Your solicitor should be able to advise you.
The 'failure to stop and report' is quite a serious one too. The main effort should be in fighting this one and the DD. The helmet one is laughable and should be chucked out. The tyres, well, either they were bald or they weren't. |

So, sounds to me like they are very shaky ground since the road traffic act makes specific mention of the fact that only the person committing the contravention is guilty of an offence. I think a good brief would make total micemeat of that one. |
