after a bit of advice

about 2 weeks ago I got knocked off my bike on a roundabout. Some blind twats rear ended me and sent me and the bike flying.

Anyways, The bike has just been assessed and the damage is at £5700 all from a 25 mph lowside .

They have valued my k6 gixxer at £6800 (paid £7800) which is reasonable i think as i expected to lose £1000 just riding it out the showroom anyways.

Any ideas on what the 3rd party would do with that, do you think they would repair it or write it off. the damage is at 84% of its pre accident value???

Considering the bike is only a 4-5 months old do you think i can fight for a new bike as i have just been screwed over through no fault of my own.

anyone been in a similar kind of situation or anyone maybe shed some light on this and tell us how long these kind of claims take

another question i forgot to ask was, the bike is running like utter crap. It doesnt feel half as powerful and its making some weird noises now too. Any chance there might be something wrong in the engine??

Shall i decline the assessment of the £5700 damage and tell them to drop the engine as well?

Oh sorry to keep rambling on but do i keep salvage if they write it off??

Doesn't matter if they value the engine and find more damage, a write off is a write off.

And 84% damage is definitely a write off!! But you might be able to wangle a bit more than £6800.

Make sure you're claiming for your gear aswell, lid, leathers, whatever.

You'd have to talk to his insurance company about buying back/keeping the scrap. Quite often they really don't want to take it away, and they'll say, either you can keep it, or you can pay for them to scrap it.

With a mates written off bike they just never came to collect it.

Sounds like you will come out of it with a good deal (bar the obvious trauma of being knocked off). If you can get £7300-7500 and keep the salvage which must be worth a fair bit as it sounds like you are still able to ride it.

Yeh i will try to haggle for some more on the bike. So far i got it as follows

Bike - hopefully £6800+
gear - £600
loss of income - £1000
personal injury £2-3k

Just dont know how long this is going to take, thats whats bugging me. Because i got no witnesses its his word v mine. Even though that cunt hit me from the back

Also throw winter depreciation into the mix with the offer, whatever they compare it to will be down in price at this time of year compared to the summer months.

I thought a write off was generally around 60% damage to the market value.

More importantly do you have legal expenses?

You know my opinion on this, I wouldnt stop harrassing my solicitor to stop harassing the insurance to get it written off, You bought a new bike not a second hand one why should you have to tolerate a crashed and repaired bike because some d!ck took you out.

It's not like it's a cheap run around for winter..

Remind them about the (minimum) £75 a day bike hire costs to get yourself another gixxer whilst yours is being fixed - I would seriously look at getting one immediately. They'll soon just pay up for a new bike as it will cost them far more to fix yours and keep you mobile during the repair.

If you haven't got legal cover with your insurance, get on to helphire or ridersupport swiftly.

Biker legal Defence have been a great help but at the moment i got my solicitor doing everything as she gets it done pronto. As for the hire bike its £90 a day and i can see how it would hurry them up but the thing is its my word v his word. If he some how wins the claim im stuck with £90 a day for 85 days, thats nearly £9000. I couldnt ride it anyway like i said my leg is useless, bad strain in my knee and ankle ligaments.

If i claim that im scared of riding, do i have to stop riding permanently

Helphire will insure you against it. They'll basically give you a hire bike if it sounds like you're not to blame - but ask you to take a £10 insurance policy, just in case it goes against you (which is refunded if it does go your way). Needless to say, if you speak to Helphire and they think it sounds like it was your fault, they'll probably decline to help!

Contact them, get a hire bike - whether you can use it or not, you're entitled to it. Start to rack the costs up and the insurance company will be pretty quick to stop dragging their feet.
