If you are involved in a road accident and your passenger is injured but not severely (e.g few bruises. aches and pains etc).
The passenger then decides that they are going to put in a claim against you for negligent driving.

Who actually pays for the claim if it is paid out to them?

Does the driver pay or does the drivers insurance company pay?

If the driver is found to have been speeding at the time of the accident would his insurance company refuse to pay out and leave the driver to pick up the entire claim payment?

Has this situation arisen amongst any of you? (i.e Have any of you had a claim put against you? and has your insurance company settled the claim or deserted you?)

I ask this question as my son was involved in an accident as the passenger but is unsure as to whether he should claim against a close friend.

Well seeing as insurance is a big pot of money paid out to those who need to claim , everybody pays but the driver will have his insurance loaded heavily for 5-6 years 1-300% is not uncommon, as the insurance companies and all insurance companies have a gentlemens (which is more than likely illegal) , to load the insurance of anybody who is involved in an accident.

Since this is a friend what do you value more? money vs friendship? , since you can certainly guarentee they'll hate you for loading their insurance ONTOP of the insurance loading they already had from the accident stated earlier.

The driver's insurance pays.

Most companies look at the total amount of the claim and base it on that.
If you're lucky, some companies will just ask if you've had a claim and not how much.

I've claimed as a passenger in a crash.

my mate crashed and his mrs claimed off his insurance. she got 2k. that more than paid for his insurance loading and a little weekend break too.....

I use to work for a car insurance company and the injurys would be paid for by the insurance company.

Usually the insurance company will not take into account the total cost of the claims only if money was paid our or not (ie. fault or non fault accident and if any money paid out was claimed back from another insurance company) - basically it always comes down to if they have had to pay out, that is what is taken into consideration at next renewal.

Agreed, but for the opposite reason. Because the claim against me was quite small and nobody was injured it didn't affect my premium at renewal time and they didn't adjust my no-claims either.

As it says, No Claim Discount.
If you Claim you lose the discount.
(Unless you pay for Protected No Claims Discount.)
An sensible insurer would ask if you claimed before. I'd hope they would ask how much the settlement was?
If my insurers take on 'bad risks' I would like to think they collect the higher premium for the extra hassle.
And you should pay more for driving like a fool.
Why should I have to pay for careless drivers? Evil or Very Mad

Why would your friend not want to claim?
I would claim.
If the person takes the hump for the claim then tuf.
So that is a friend? Shocked

We all pay for it!

Every claim, wether genuine or not ups the premiums in the long run. Al these compensation claims come out of our pocket hence thats why insurance is so damn expensive.

I haven't had a claim for over 3 years, but some companies go back 5 years when getting a quote so I have to detail 3 claims (1 fault, 2 non-fault). They do to ask how much the claim was for - how the hell should I know? I have fully comprehensive insurance with 0 excess. I pay nothing. I have no idea how much it cost, they just loaned me a hire car, fixed my car up as good as new and then gave me the keys back.
