Hey..Well i was riding along the road and there was an unmarked island in the midde of the road. i didnt see it at all because it was raining and i went straight in to it and my m8 followed lol. I went over my handlebars head first on2 the ground and my bike flipped with me several times and landed ontop of me, then i saw my m8 go flying in the air passed me without his bike, that was lying on the floor 20 yards away. well my freind that was also riding did not end up in the crash and picked the bike off me. i had not a clue at the time how i fell off. so im sueing the council because the island was not lit or marked.

here are some piccys Smile

How about they sue you for damaging the island or road? Sorry to hear about your accident but try and learn from it rather than blaming someone else.

Oh yeah, see my sig.

By middle of the road i presume you mean between lanes?

Not wanting to be the bearer of bad news but you wont get a penny from the council especially if it's in the north west, they are vicious. From the sounds of it you weren't in lane and you just stated that you didn't see if because it was raining.

Local councils wont pay out without a battle, their main tactic is to counter sue for damage to public property

ie blokes van gets damaged by over hanging tree branches, he tries to claim from the council and they counter claim for damage to the tree and structural damaage to the pavement due to movement of the roots, and they won the case.

Least your not hurt though Thumbs Up

If you hit a statitionary object then forward planning, concentration and riding without due care and attention are surley to blame rather than the council.

If you cant stop before hitting something in time then you are travelling at a speed unsafe for that instance.

The only way that the insurance will pay out is if you were to claim on your own policy and hence loose 2 years NCB and increase next years premium.

By the description of how your bike flipped repeatedly and your mate flying for 20 yards I suspect you may well have been travelling a little to quickly for the road and conditions. My assesment? You are f**cked.

What's the "Woooo" bit? Are you happy and excited?

Or was that "Woe is me"?!

Why is it some people think they have to come off to increase their standing - gives them something to talk about, maybe?

That said, glad you're ok, and will recover from this hopefully in a better state. More than can be said for your bike and wallet.... Wink
