legalities of found property

Just under 3 months ago I found an abandonded bike and called the police. I registerd it with them as found/lost property. As yet they have not been able to trace an owner. It is not registerd as stolen. If the bike is returned to me after the three month period what are the legalities of ownership, also is anyone aware of any other problems that might occur

Think you have to register a claim for it somehow, but you can get it to be yours.

its a honda vfr 800 pre vtec not in the best of condition cosmetically and obviously dont know what the engine and box are like, but if its not going to cost a massive amount of money if i do get it then i will get it road worthy and use it. Just cant understand why someone would just dump a bike, as said before its not been claimed for on insurance and the police have no interest in it.

Assumed it was an knacker with no identity.

If it has a numberplate then you need to make serious efforts to contact the owner, via the DVLA.

Police disinterest likely just means it is not reported stolen and no illegally parked. Beyond that they probably have made no attempt to contact the owner.

The bike has an identity, the police have been to see the registered keeper but he said he sold it over 18 months ago, it also has a datatag but this is registered to the registered keeper. its also not been taxed since the end of 2005

When someone sells the bike, Isnt it thier responsibilty to fill in the V5 and new keepers data, Signature from both parties then send off? (Or is it not too important who sends it off?)

Write the the DVLA and request a V5C for it - the DVLA will write to the registered keeper to say that there's been a request for it to be re-registered in a new name.

If the current registered keeper doesn't respond within a set time (14 days I think) then DVLA will send you a V5C in your name.

Of course legal title is not the same as registered keeper, but if you can prove you've taken all reasonable steps to trace the legal owner you shouldn't have a problem.

You might like to check that it's not subject to a finance deal by doing a HPi check on it, just for peace of mind.

Joking aside , ring the DVLA and they should be able to give you advice, From memory if the thing has been abandoned then you can register it in your name. I think there were some traffic wardens in London a few years back who used the abandoned vehicle loop in law to get loads of cars and the like to sell on. they were on the fiddle but you can still use the same bit of law. like I said talk to the DVLA and they will help.

Tell me about it.

For a whole year i was arguing them about the whereabouts of my Registration Certificate.

They said the dealer had it, they dealer said i had it and i knew i hadn't got it.

Anyway, it turns out the DVLA sent it to the wrong address and refunded me the £19 to replace it - to get my tax done.
