To those who have been to court for speeding...

Well basically, was reading a post the other day and somone said about only getting 1 week bans etc.

What i want to no is, if i say i have been using the bike everyday since i got caught, to get to work, can they check? Asking because i havnt actualy used it this month as my insurance and MOT ran out and havnt bothered to re-new due to this pending conviction.

So, can they check? and what would be the likely hood of them doing so? Im hoping it would cut down the ban (if a ban is what i get..) but im obviously not expecting 1 week... Sad

I can't see how they could check it... until the big brother state takes hold and gps systems are installed, they don't know where or when you've ridden your bike.

I got off a ban and instead had a heavy fine by saying that if i was to loose my license then i'd loose my job. Might be nice to get a signed statement from your boss saying the same thing. Very unlikely you'll get banned that way

I doubt they would but, if you say you've used it everyday and then they see you haven't had tax and insurance then I gues they could either do you for perjury or driving without tax and insurance on top of speeding!

Why would it matter if you've been riding your bike if the case hasn't actually come to court yet? Confused

Until it does you are not banned and can ride as long as you are legal in the other ways (insurance, MOT, tax etc) with no repercussions surely?

Or have I read this wrong........

Not quite speeding but I went to court for careless driving. I was just coming towards the end of my two year probation period (2 months left).

I had spoken to a solicitor to try and figure out how many points I was likely to get. He told me that a CD10 is anywhere between three to nine points. He advised me to state my reasons as to why I should keep my license.

At the time I had three part time jobs and I was studying at Uni so it was handy to have my own transport. So I simply told the magistrates that I had three jobs which were paying for my Uni course and I needed my licence to commute to all these jobs.

They ended up giving me 5 points and a £120 fine and told me to be careful in future. For all they know I could have been lying about the jobs and Uni course.

Hi

Lying under oath can result in a prison sentance so I would not bother if I were you.

If you trying for mitigation the effect on others not yourself carries more weight.

to be honest mate, just tell the truth

you say your insurance and MOT ran out and wasn't renewed due to your worries about the pending court action...

that can work in your favour possibly.. depending what you did

you state that you haven't been able to ride your bike for x amount of time the reasons of which were due to the pending court date so financially you didn't see the point in doing these things if you are expecting a ban (you need to save money for civvy transport)..

however you can plead with the judge as to your hardship. having limited or no means of travel is placing strain on yourself and beginning to effect your health and placing large amounts of strain with peers and close ones... add to this the fact you are now facing financial hardship you realise how much you need your licence as necessity and you have learned your wrongs... you feel an extended ban can have serious and adverse repecutions on you

perhaps something along those lines... you are being honest and straight up with the law and have less to worry over Karma
