I sent off my documents the other day in order to get my cheque for my written off bike.

I recieved a letter this morning from my brokers saying that they were ''unaware'' of my Rizla Paintjob and they want me to write back stating how much it cost and why i didn't disclose this when renewing.

I DID tell them i had a paintjob when i renewed it (twice) but was told 'It didn't count.'

I can't remember the womans name i spoke to (why would i?) but now i risk losing more than i bargained for!!! Evil or Very Mad

On topic, was the 'phone call recorded?
If so then may fall under the data protection act.
So you can ask for them to retreive it if required.
If they say they haven't got the recording then threaten a report to data protection registrar. Data must be kept for a set period (at least 12 month for what I recall).

AFAIK, you are a consumer, therefore have a legal right to a transcript of the call, and/or to listen to it, and this may be covered under the freedom of information act, they should opt for transcript, as 'there may be personal details in background', and the transcript has to be spot on(maybe get some free legal advice about your rights, or if someone else can verify)

if you told them, tell them that. They will listen to the call and allow the claim. If they still dont allow the claim, saying it didnt count then threaten FOS action. If you go to the FOS, they get charged £800 fine up front. So chances are they would rather pay it out than have you go to the FOS

Tis true I can confirm that ALL insurance companies have to take details over the phone recorded for legal reasons and you are legally within your rights to request a copy of the transcript from the on site data manager.

If you are heard to be telling someone about the paintjob and they brush it off as not important THEY will get shafted not you - although they will try and wriggle, just stick to your guns and make them pay Very Happy
