PostPosted: 20:45 - 23 Feb 2007    Post subject: Ground Anchor legal issues Reply with quote

Hey folks, ive got a wee problem:

Ive just had a letter from the factors who maintain the upkeep of the grounds of where i live stating that they have had complaints about the location of my ground anchor. See the pics:

https://img366.imageshack.us/img366/9414/dsc00025rx5.jpg
https://img401.imageshack.us/img401/8690/dsc00026rk3.jpg
https://img93.imageshack.us/img93/9329/dsc00027io4.jpg

Its located in an area "designated for turning" but as you can see it is almost right against the curb and i can tell you that people have regularly parked their cars in the same spot before i put the anchor there and even then it was not a problem to come out of the spaces at the end.

Now, this isnt the first letter of complaint ive had from the factors, i had another letter about 4 weeks ago regarding complaints about the noise of the bike in the mornings when ive been goin to work. To be fair, before i had the letter i did; go downstairs, start the bike, remove the cover and take it back up to my flat, come back down, put on my helmet and gloves and then take off for work. All of which took about 5 mins and i can see why the folk might be annoyed at the bike running for this time. So after the letter i started taking the cover up before starting the bike to save noise.
I did phone the factors and say that was sorry but that i cant help it that i start work at 6 in the morning and i said that i would do my best to reduce the noise.

I reckon this second letter about the location is a load of pish and the folk that are complaining really just want me to move the bike away from their flat so that they dont hear me start my bike for 3 mins at 5:30am mon to fri every second week(i work a back shift every other week).

A few questions:

Did you check it was OK to fit the ground anchor there with the owners of the car park/flats?

Is your exhaust a road legal one?

They have told me to move the anchor to a "more suitable" location asap. i chose that location because i thought i was being considerate by not hindering the car motorists taking up a parking space.
I will phone them up to argue my case and ask where a more suitable location might be but i wanted to ask you guys for advice first.

Thanks in advance,
Si.

PS. Feck knows how i'm gonna remove the anchor anyways, its a security device thats not meant to be moved. Laughing

I think they are being very reasonable. It is their ground so they could tell you to knob off.

Just move it - kick up a stink and they may well decide being charitable isnt working and tell you to do one.

Thumbs Up

I guess you can ask them to recommend a suitable spot, then you are complying with what they want and not being intransigent. But i mean the noise of the bike in the morning? Im guessing cars dont make noise. Or at least not to car drivers.

Be VERY carefull when you remove it! As you didn't ask permision you could be given a bill for the damage it has caused to the road surface.

Before re-locating it ask them if its ok to drill four holes in their property and try to get it in writing or it could all kick off again.

Not as much as bikes...There is no need to start it and let it run for five mins before riding off. Just remove cover, chain then put your helmet on, start bike and ride away. Bikes don't need to be warmed up they are the same as cars. As long as you don't thrash them there will be no problem. Thumbs Up

Although they are well within their rights to tell you to move it it does seem they are being arsey for the sake of it. Looking at the pics it looks like the most sensible place to park and i can't see a more suitable one.

They might have a point with the exhaust, we can't hear how loud it is or isn't, but i'd be tempted to fit a standard one. It's one less bullet in their gun.

It sounds to me that its likely to be just one person complaining out of your block. Try and drum up some support to back you in writing. I agree that it does look like the most sensible place for the lock, so if your dealing with your local council you will more than likely get stiffed.
In the meantime, start to take up a whole parking space, it is after all, your right, you pay your rent and taxes. Even better if you can work out who the mystery whinger is, and park in there usual spot as often as you can, even if it means moving your bike when you see them nip out..

just noticed.......You need to get as most of that chain as you can off the ground or your making it easy for anyone wanting to cut through it. Also a sledge hammer on that lock will get it open so make things harder for them by getting it off the ground too. Wink

Could it be that people have complained because your bike may partially block the tarmac between the paving slabs which have been put down as a walkway?.
It looks from the photographs that people when they step off the paving slab would have to walk around your bike to walk straight onto the next slab. Petty I know, but you know what people can be like especially if they are prejudiced against bikes! Rolling Eyes

Following on from finglonga, move your bike back a bit, run the chain through between the swingarm and shock, keeps it off the ground and is more akward for thieves, plus they cant just take the rear wheel off and take rest of bike... its real quick and easy to get a rear wheel off....

I wouldn't worry about theives busting the lock, they can just wait until the sun has been on the tarmac for a few hours and just prise the anchor out with a swiss army knife Shocked

I'd go with the advice of being considerate and starting the bike just before you want to pull away.

It does sound like a case of someone with a bee in their bonnet.

Any car that fitted into one of those bays would be able to reverse-up to the car in the opposite bay and drive off - there's plenty of room. Also, any vehicle that needed to back out of a parking bay could just as easily turn the other way and reverse out completely. Most car-parking areas of that sort don't have an area like that for turning.

Unless you have designated parking bays if you fix your anchor into a bay how are you going to be sure there won't be a car parked in it when you arrive home?

I would say that you've adopted a sensible approach, fitted a tidy-looking anchor and put it out of the way so as not to use up a full-sized parking space.

Having said that, I don't see how you are going to get around your problem easily. Even if they accept that you need to chain your bike up, the fact remains that you have introduced a trip-hazard to their public footway and car-park and if they let you keep it there they are leaving themselves wide open for an injury claim. I can't see them letting you keep it there.

BTW if they kick up a fuss about the damage to the tarmac you can get small bags of cold macadam from Wickes etc, just poke it in the holes to fill them in and tamp down fimly.

If I was the landlord, and one of my tenants bolted a huge permanent piece of metalwork to my pristine carpark without asking, I'd do a darn sight more than to write a polite letter asking him to move!

Id say it was the owner of the corsa or whoever parks opposite that has complained.

Just ask the factors where you should put it. They might be able to lay more slabs on the grass and you could get the anchor in the corner of that parking space.

I would be worried someone would reverse into it there, especially if they have already complained about it twice. "I told them they shouldn't park it there" type thing Evil or Very Mad

I think you need to work with them to find a alternative spot to park the bike.
Putting your case forward from the point that you are trying to help other residents by not blocking a full car space, might help. You have already complied with them on one occasion, so have shown willing when asked, so now can they help you in return. You could also say you have never complained about noisy cars (banging doors etc) when you are trying to sleep on a night.....

You must have been really lucky to not have got the bike knocked over by someone reversing when their windows are all steamed up in a morning.
That area can hardly be said to be a turing area, coz if all spaces are in use there isnt enough room for a car to turn round.
Perhaps suggest to them that, they put a sign up asking ALL drivers to reverse into the spaces....

Are you not entitled to a full size parking space in that parking area if you live there? If so just move your bike into a full size space and tell the other residents that you are just as entitled to use a space as they are.

As for your ground anchor, as soon as I saw the pics I shuddered. Tarmac is very weak stuff and a decent five foot pry-bar jammed through the loop and forced upwards will rip that straight out of the ground. It'll take a bit of a lump of tarmac with it, but a thief won't care about that.

I would move the bike regardless of the complaints if it was me because A: You need to anchor it down to something more solid and B: Where you have it parked, sooner or later someone is going to reverse into or clip your bike whilst turning and knock it over.

That tarmac looks a bit soft, if you hit the lock with a sledge hammer you'll end up burying the lock Laughing

I think the only option is to ask them for their suggestions. If someone is complaining about the noise then it won't make much difference if your 10 foot or 100 foot away, they will still complain. As suggested point out that you require a method of securing the bike, show them whats recommended and ask for their advice.

Nah...There is a ready made anvil bolted to the floor and enough slack to get the lock on top of it...wouldn't take long.

Plant it in a parking space and you will create a tripping hazard. It is safer where it is (But as said with decent bolts).

By the look of the 2" bore in that exhaust i'd say its a straight through race can. No wonder they complain. I wouldn't be happy to hear that at 5.30am & i've got the same can on my own bike!!
The car park looks pretty flat, can't you just push your bike away from the houses before you start? I bet it echoes like mad where it is now.
