Hi, I have recently sold a smashed corsa for £60 on eBay. I got an email from the winner saying:

hello,
we are arranging for a pick up of the car on monday afternoon, could you give me your full address where the car is and registration..
our name is David ma**ing can you put the v5 log book into his name (my husband) our address is s*cross lane, reigate, surrey rh2 8**
our phone number is 01737 2213**
our driver Marcus will pay you cash for the car on collection, can you make sure you have all the paperwork etc, keys for him...
look forward to speak to you soon..

I have not confirmed whether this is okay and whether I will be present. I then received this just now:

Sir you need to come up with our Corsa which we have legally won, we have found your home address using your post code and will file a complaint against Mrs Cunningham, Mrs Snell and any other occupants at your address, we will also file a complaint to the police that you have under contract law, stolen our car from us which we have legally won on ebay, which are now watching what you are doing, we will file a complaint in the courts for £1,000 lost of profits, punitive damages, losing a day at work, wasting the time of our transporter. which will be including anyone hiding you at moody addresses, so Sir..come up with our car, now or I will see you in court...yes, we will find you - the internet is easy...

I have no idea who the hell Mrs Cunningham or Mrs Snell are and the auction ended Friday.

In all fairness i think someone is being a tit.

First of they have sent it CC the police etc when it contains threats in it such as "we will find you" besides they aren't even supposed to be picking up the car till tomorrow? Have you replied to the first email?

I have not replied to the first email. My intention was to reply to it once I had the chance but while entering my email I saw a second one and thought I should ask for advice before proceeding.

I think that bit sounds dodgy too... The whole thing is dodgy!!

Send an email to the buyer (or maybe eBay) asking for their name, then only give the keys to someone with proof of ID.

Is the second email from the same person? Ring her, she's given you her number in the first one.........

Sounds to me like her pc may have been hacked, if she wanted to collect tomorrow (nearly today) you should really have replied by now, especially if she has to get a trailer or tow to get the car home.

V5 goes into the name of whoever collects it, don't know but with them sounded vaguelly dodgy you could ask to see their driving license or something else to confirm who they actually are.

I'm sure Surrey Tax office will be really concerned about a sold as seen £60 car on eBay. As would the police and it's a civil matter, not a criminal matter. eBay, well, I doubt they'll even read her email; disagreements between a seller and a buyer aren't anything to do with eBay.

Under contract law stolen their car from them, lost of £1000 profits, punitive damages and wasting the time of their transporter, well, the contact is from them to collect a £60 sold as seen car. Good luck to them in trying to claim anything else through a court, it would be small claims court anyway.

"Come up with our car, now or I will see you in court" Whatever. Laughing Arrange for them to come and collect it, as has been said not being at home on your own would probably be a sensible idea.

Any emails to them put "Without prejudice" at the top, any documents headed "without prejudice" cannot be used in evidence in any subsequent court case without the permission of both parties. Chances are they're unlikely to know what it means and legal jargon is usually good for worrying people. Razz

Just look how there started, I think its not the same person to be honest, there writing styles are totally different, you have there number( if that one is fake you can get the buyers proper number of ebay) why not give them a ring and discuss it in a calm, friendly way. explain the situation and get them to say there side of the story, keep it calm dont argue with them and I bet you can come to and agree ment between you.

Firstly what is the buyers feed back rating and how long have they been registered, secondly save the emails because you may need them at a later date and thirdly the car is not theirs until you they have paid for it, you are only legally bound to release it upon receipt of payment, which they are legally bound to do.
Also i agree with what others have said about having someone with you.

Following up the topic, I have sent an email back to the buyer and reported them to eBay about the tone of email:

Prehaps this was a misunderstanding or the buyer got scared by eBay enforcement?
