Westminster Parkies again.

This time, they've lifted up my bike cover at the back, in order to give me a parking ticket. Of course, ignoring the strip at the bottom of my numberplate that tells them my permit number and the location of the permit itself (front wheel).

I've had enough of this. Anybody got any links to places that cover the legality/illegality of traffic wardens removing an item that's obscuring your numberplate? I'm going to put together a little case this weekend...

Tie a shotgun to your back seat, using pullies to link it to the bottom of your bike cover. Very Happy

Or go for harassment. Say they keep targeting you, specifically, even though there are plenty of offending cars on the street. Also say that they're obviously not competent in their jobs or they would have seen the sticker and/or the permit.

For some reason this really infuriates me. Evil or Very Mad

The site that guy posted is quite good

https://www.motorcycleparking.com/

Quote:

Covering your Vehicle Registration Number (VRN) and tax disc

As noted in Parking Ticket News June 2003, under the Vehicle Excise and Registration Act 1994 it is an offence to either fail to display a vehicle excise duty disc or obscure a vehicle's registration number (VRN). This offence is, and can only be, dealt with by the police. In the event of non-compliance, your vehicle could be clamped or towed. Motorcycles parked in this manner should not receive PCNs from traffic wardens, since there is no legislation that specifically empowers them to remove obstructions in order to gain the information required for issuing a PCN i.e. a VRN.

some interesting stuff here https://www.parkingticket.co.uk/ca.html

which also included this gem:
Quote:
Competition amongst Westminster PAs as to who can issue the most tickets before December, and win a Vauxhall Nova, appears to be hotting up. Last month a PA ticketed three fire tenders as crews attended a blaze in Piccadilly.

Emergency services vehicles are exempt from parking restrictions while on official duties. “We have spoken to the Fire Brigade who have confirmed the vehicles were on a call and have cancelled the tickets,” said a council spokesman. “We shall be following up this particular incident and have instructed our contractors NCP to remind all parking attendants in Westminster that emergency services provide an essential service and are exempt from parking restrictions when on official business.”

Maybe you should get in touch with the BMF or maybe a newspaper or something?

I've just read this website some more and there are some amazing stories in there. Traffic Wardens must be the most stupid breed of people on the earth!

Quote:
A motorcyclist was ticketed in a solo bike bay
because his bike was at the end of the bay and he
had turned his handlebars on opposite lock to allow the
adjacent bike some room to be picked up off its
sidestand. This meant that, although not touching the
ground, the front tyre was technically over the edge of
the bay

He took digital photos and wrote a polite letter requesting
the ticket be cancelled, but the council refused on the
grounds that there was no time and date on the photos!

And there are loads more stories like that!

Traffic wardens are not stupid people they just have an incentive to give out as many tickets as possible.

Okay not stupid....just evil!

Oh..., and from reading one of those sites it seems we have to differentiate between parking attendants who are the evil ones, and traffic wardens who work for the police and apparently aren't so bad.

Razz Very Happy

Unfortunatley the best that will happen will be a parking warden getting a bollocking, when it's the whole system that there's a problem with Evil or Very Mad .

I think the Police traffic wardens only do bus lanes etc.. and I don't think they have as much/any incentive to give out tickets.

I have been arguing for over a year bout a ticket I got from Westminster, even though I was on private property. Its now gone on to some parking arbitration people in Sutton Surrey.
their guy came down to survey the site . really bloody ridiculous, must have cost Westminster a fortune for the paperwork they produced.

I was also told that covering the plate may not work as the councils are looking for a test case to try in court.

So paulit, I can actually force this issue through to the point where a third party gets involved? Interesting...

I think this weekend I'm going to have a dig around, pull all my letters to/from them together, print some photos (dated) and so on. Then I'm going to get in touch with some websites, and probably write to MCN as well. And I think it might be time to start wandering round with my digital camera gathering evidence - wish I'd taken a photo of the knocked-over SR that they ticketed.

There is an official arbitration service for parking tickets, but your situation sounds like you could have a case for harrassment.

Check out the links I posted above too, the second one is particuarly interesting. Karma

you can only use the parking appeals people if you have refused to pay the ticket and agreement cannot be reached. Westminster will send you a form to fill in and send to the Parking Appeals people.

It takes an absolute age for anything to be done. Got to be honest, If you were illegally parked then you are on a hiding to nothing, but the more of us who argue the more work the councils will have to do and maybe then they will re consider their approach to motorcycling tickets.

Its not really the wardens fault, they are told to ticket and thats what they do, its the idiots at the councils who make decisions that are to blame. meanwhile they are happy getting around in their chauffeur cars or with dedicated parking places.

Bendy the amount of times that they do it surely it must be at a particular time? If I were you I would actually wait with your bike in view and when they go to give you a parking ticket go over and rip the guy's head off. Point out that they've been doing it for god knows how long despite the fact you have a parking permit and say if it happens again you will take legal action, get a witness there too. Then if it happens again you will have a rock solid case because you have actually informed them that you have a permit, so they can't just turn round and say 'uhhh, didn't know she had a permit'.

I've had them at all hours of the day, and looking back through my tickets, it's a completely random selection of wardens, not one in particular who's got it in for me. The last time one actually spoke to me, I was cleaning my bike and she came over and said I had to move it. I said 'no, there's a permit on the front wheel'. She looked, then said 'Where?' so I got up and pointed it out for her, eliciting a vague grunt of approval.

She then came back 10 mins later with another PA who also looked at it, said 'Can't you put it a bit higher?'
I asked her exactly where she would put it on that bike and she said 'On the windscreen'. I pointed out that it would a) probably get stolen, b) probably get wet and ruined, c) that it's a huge great square of paper and I can't exactly see through it and d) that when I bought my permit I was told to put it in a tax disc holder.
She wasn't having any of this and basically started shouting at me and I started shouting back, then the two of them wandered off.

The thing that pisses me off the most is, I don't cover my bike so I can park illegally, I pay £70 a year for the priviledge of parking outside my house (the same price as a small car). I've had so many tickets that I've taken to covering my bike just so I don't get any more - I always cover it at night for security but during the day if I was coming and going, I wouldn't bother. Now I do. This will be my main argument if they say I wasn't displaying it... when I do display my permit, I get a ticket anyway!

Calm blue ocean. I shall rationalise at the weekend Smile

If they KEEP doing this to you then talk to them about harassment and maladministration. If you have proof of how many times you have been booked despite having a permit then you can usually go through the official complaints procedure.

Or get a plate made up written "The permit is...." and then they will actually have to read that.
