dont really know much bout insurance cats mate but are you fully comp? or have you goto repair the bike yourself?

went into a back of a car. cant remember what happened, although that is what ive been told.

A women turned infront of me without indication. SHE is also NOT insured.

Im only TPFT so I cant claim on mine. what I plan on doing is asking her to pay for the repairs and i will not take any further legal action.

Cat D at least mate. It looks as though the subframe or swingarm could be bent? Both can be replaced, so no major biggie there. Tank seems to be pretty good condition, and the bodywork doesn't look too bad. Just a dab of araldite should sort it. Wink

What's bent - your swingarm or your rear subframe? (can't see on pic)

If the swingarm isn't bent - can it be used as is?

swingarm looks fine. the front and rear wheel are lined up ok, so must be just the subframe to replace.

Rear sub frame is bent by the looks of it. It will be a write off because of that i think? And if youre making her pay for the damage get her to sort you out a new swing arm aswell, cant possibly be seen riding about on that. Very Happy

Get it all checked - but if that swingarm is straight then I'd use it as is. To be honest, you may have a better chance of getting money out of her if you only ask for necessary bits. If you hit her with a huge bill for new parts there's more chance she'll avoid paying. Also would be worth offering to fit new parts yourself.

If someone crashed into my bike I'd exepect it to be EXACTLY how it was I wouldn't be making any compromises.

Exactly, the way hes talking hes gonna let her get away with quite a lot of the damage. Make her buy *all* the bits shes damaged, forget *fixing* the fairings, buy some new ones, it wernt your fault she knocked you off and she didnt have any insurance is it??

even if 'comprimising' could get you a better chance of getting some cash? Has R6Stu got a witness if it all goes to court. Will she definately turn up? Has she done a runner? Could get messy if you go in guns blazing IMO Confused

I thought the police had all the information they needed to find her. It might take a while but its better to get what you deserve at the end of it instead of compromising. Put it this way, if it was the other way around do you think she would let you get away with anything?

Agreed! It's time she found out why it's the law to buy insurance!!!

It is one of my pet hates when I find out that people don't have insurance. What if they hit a kid and they need an op? Then they're fucked and rightly so!

Bikes aren't exactly expensive, if it'd been a car she managed to total it'd be in the thousands. I'd be aiming for the lot, I pay enough in bloody insurance premiums I'd bloody well expect it.

How badly were you hurt because of this?. Did you lose time off work due to that. Do you still suffer pain from the crash.

She has no insurance. Ask her to pay all expenses to get the bike fixed and tell her you will wave any personal damages. Make it clear to her that she needs to put the bike back in the condition it was. Get a quote to fix everything before you speak to her and increase that by 10-15% as a guide line price.

Personal damages if you took her to court would amass to alot more than repairing the bike. As she has no insurance she would not stand a chance in court.

If she has any brain cells at all, she'll pay for the repair and leave it at that.

Don't feel bad about stinging her for the repairs as it wasn't your fault.

If she's willing to give you a cash settlement, draft something up on paper yourself, date it and both sign it.

If she prefers to do it the harder way, get her solicitors details and get yours to deal with it through her solicitor. Make her aware of the fact that she will pay more if she wishes to use a solicitor as she will need to pay for your solicitors fees as well as her own.

If she's on a fairly low income etc, then she can probably get away with paying £5 a month through the courts, so may just go that route.

Probably stop after a few and you'll have to spend loads more sorting it out.

(not entirely sure how the system works in such cases though Confused )

Well I still cant remember anything from the day before the accident and the next few days!

I was kept in hospital overnight and have been signed of work for a week Laughing with a head injury!

Sub frames always go on r6`s and r`1s when they crash and as they are welded on the write the bike off for it as to fix it your meant to get a new frame.
