You would have been but you didn't make a one off payment, you entered into a finance agreement with a third party to pay for it. You essentially bought your insurance on hire-purchase. What'll happen is the finance company will claim that money back, keep it, then screw you over on the cancellation clause for the finance agreement.
That's how it works I'm afraid, you've been screwed over and there is nothing you can do about it. From a legal point of view, you are breaching the contract.
Moral of the story, read the small print before you enter into a finance agreement. This subject has come up more than once on the forum. In future, you would probably be better getting a bank loan to pay your insurance in full.
There was an interesting one a while back because the person in question was 17 and therefore not legally considered old enough to enter into a finance agreement. He shouldn't have been offered one and was under no legal obligation to pay it back because they failed to get a garauntor. 1st year of insurance is a short period cancellation rather than a pro-rata return, this is to compensate for all those dodgy geezers never paying up, after a year of insurance the insurer 'trusts' you
The cancellation fee is a bennetts thing not the insurance company, brokers love admin fees.
In short you're always buggered if you cancel mid-term in the first year of insurance.  |

Yeah I know. I wouldn't care about the cancellation fee it's just that 240 quid, it'd make things better if they offered a years no claim.
Cancelled DD anyway so the cunts can wait for their money.  |

I know about credit ratings and that malarky.
They can't take the money via my card without permission as I will ass rape them.
I'm waiting for them to contact me, which is when I'll start a complaints proceedure. I know how it all goes. |

did you buy it online or over the phone? if over the pone, there is a legally binding contract in place from the moment they insure you until the second the policy runs out/they canx etc.. A phone call "verbal contract" would stand up in court as long as you were somehow informed at the start of the call it was recorded, if not, then the advisor you spoke to could stand up in court, they would just use the recording to 'refresh' his/her memory. I chose to pay by installments
with bennetts, then phone up not long back, and paid it all off in one go but didn't get charged a surcharge fee for doing so by them or the finance company

If you are going to fight it then the best way is what FIRE_NSR on the other thread suggested.
Speak to a manager and claim a breakdown of all the charges as you are entitled to under the Data Protection Act.
Say something like:
"Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to my account with yourselves."
Very few people actually know anything about the Data Protection and the Freedom of Information Acts so it has a tendancy to scare them.

Due to the DPA your entitled to do that. Never trust the guys over the end of the phone, call a manager, your also entitled to do that, no matter what they might tell you.
All calls are recorded and regulated by the FSA, they cannot F*ck you about for money. Believe me! |
