hi guys and girls i was just wondering whether any of you could help me

i won an auction on ebay from M&P for a carbon laser hotcam half system for my blade, i paid by paypal and got the receipt and M&P confirmed that they had received payment, then later in the day i get an e-mail from them saying that the system had been irreparably damaged and there were going to offer me a stainless can as a replacement, Mad
does anyone know where i stand can i demand a replacement for the carbon system or do i just accept the stainless can?

Check what the auction small print says, but basically you agreed to purchase it, and they agreed the sell it to you. You shouldn't settle for a different product, especially as stainless steel cans are cheaper than carbon.

M&P seem to be making a bad name for themselves right now, they have been putting Akapovic cans for ZX6R's for very cheap prices, waiting till lots of people order them, then turn around up change the price expecting for a certain amount of the people to accept the new price. They've done this several times Confused

I would at least ask for some finacial compensation to make up for it if you deceide to take their offer. If not tehy should give you a full refund, includign any fee's and I'd be tempted to hassle them to give you some finacial compensatiopn (you coulda bought another can in the time and you /need/ this can now Razz ).
You could also get them to tell you exactly the cirumstances it became damaged and consider making an official complaint on ebay if it was damaged previously.
Remember to leave bad feedback if they don't sort it out Smile.

I'm pretty sure that M&P mention some "auction is a legally binding contract" disclaimer on their auctions, so throw that back in their faces.

Definately don't settle for an alternative can (unless it's titanium) without financial compensation.

Whats happened with this then?

M&P have been doing this alot recently, with thier "sales" and "errors in pricing" so that you buy an exhaust which is worth £250, but on the site it is advertised at £150, then they ring you up and say "sorry, its and error, we need another £100 off you" and so quite a lot of people pay up anyway. Cheap marketing scam

Worth having a read of this/ and this.

Have read about this on other forums as well, and it seems to be happening far too much for it to just be an error on thier part.

well i phoned them up the other day and basically said "you either give me my money back or send me the exhuast i paid for"
and yesterday i recieved a brand new high mount laser carbon fibre system Very Happy it sounds great Very Happy
