Bit Of Advice please.

Just had a phone call from my brother. A car took him off on a roundabout in Newport. Driver has admitted liabilty to the Police but has no tax, mot or insurance. Basically all the left side panels need replacing along with the indicators and gear lever (All brand new replacements i would say). But with the guy having no insurance what will happen. I think the police are prosecuting because he shouldnt be on the road basically.

The bike is a CBR125 Repsol so:-

Top panel - £24
Mid Panel - £47
Bottom Panel - £56
Rear Side Panel - not sure
Indicators - £54 each
Gear lever - about £20

I know these are the rough costs because i repaired it after i had an off.

New Leather Jacket, boots, helmet and trousers £??

Oh and thanks to the two bikers in a van who stopped and drove the damaged bike back to cwmbran for us, if your off here i definitely owe you a pint.

Any advice would be great, Cheers Guys

i think there is a mystical pot of money you can claim from for claims like this (against uninsured drivers)

but dont quote me on it

Read about this a while back, try searching the BMF and MAG sites another place to look is the Guild of Motor Insurers

Hi

I think you mean the MIB

(the link has details about claims agaist unisured drivers). You can also use the small claims court to recover from the drive rif he has any money. If the police convict he should also have to pay (but if he has no money then it may take years)

Just sue him, its all you do when you make a claim anyway just the insurance indemnifies the other driver.

Everyone who buy insurance pays into the fund managed by insurance ombudsman.

But I think it only pays out for 'personal injury' and not property damage.

Contact your insurer and ask.

You can ask but if you claim it will affect your bonus. Unless protected etc.

By terms of your policy You still need to inform that you were involved in an accident.

Small claims is an option.

If the guy has no ins. tax. m.o.t. I doubt he has a J.O.B. which P.A.Y.s him either.

A criminal.

You take out any legal assistance insurance ?
If you did now is the time to use it. They should be able to sort it all out for you.

How the hell do indicators cost more than panels? For £54 an indicator I would want them to add at least 4bhp each.

Cheers for the advice guys. Hes fine except for a sore leg where the car hit him.

The price of the indi's is ridiculous but thats how much they are from honda. Could be because they use the same ones on the CBR600 and Fireblade??

MIB sounds like the option he is after if when we ring this guy later he doesnt want to pay up.

Just rung thunderroad for parts prices and it came out at about £340 all together so we'll have to see what he says. Will let you know.

If it can't be resolved amicably, I reckon you should use the small claims court anyway even if it does take years, just to teach him a lesson. Otherwise these people will just keep doing it.

when that taxi reversed into me a while back I said "I'll get the quote and you can either pay me in full in cash or we can get the police and insurance involved..."

Next day,

Had the cash...

If he's been injured then he may well qualify for the "personal injury" compensation fund...

The MIB can pay out for damage to your bike (less and excess) and also provide up to £1000 of legal assiatance for help claiming from the other party.

Just a quick update.

We have rung the guy involved tonight and he is willing to pay all the costs including labor (even though we'll fix the damage). To be honest he seemed a sound guy and was almost in tears worrying about if my brother was injured, i know he was driving without MOT, tax ETC but thats nothing to do with us now thats a police matter, hes paying the repairs and thats what we are concerned about.

i appreciate that he's paying up and everything, and appears to be remorseful, but make sure he knows that if the outcome had been different, he'd have a long ban and/or imprisonment.

Mind you £350 to pay out of his pocket is a lot less than paying insurance, tax and mot, probably for the last 5 or more years so the guy is quids in. Even if he gets a ban do you think that will stop him from driving again without the insurance, tax & mot? No neither do I.

I think t121anf is thinking of the Motor Insurers Bureau. I've had dealings with them and they only pay out for personal injury, not property. So tell your brother to get down to the Doctors immediately and be checked out for whiplash, delayed shock etc and put in a claim.
