Just got caught speeding for the first time Crying or Very sad

I know it's was my fault etc etc...

77 in a 60 (was doing 110), was a straight main road though lol.

Lovely copper.

3 more points to add to my 6 Shocked (coming off soon though) + a £60 fine.

Well a royal f**k up on part of the DVLA and the courts i no longer have a licence, i can't be bothered to go into details as im mega angry at the moment.

Wellll.....

I passed my bike test yadda yadda.

I had an accident in a car which resulted in me getting 6 points.

Went to court etc, got fine and handed in my details etc.

Got licence back with 6 points on the counter part etc.

Rang DVLA as it was close to the 2 year/6 point thing.

They said it's all ok, cool.

Rang again about a year later to double check as i was getting the yammy RS200, "every things fine" they said.

Get stopped for speeding (as you know), ring DVLA about the 6 points about to come off, they NOW tell me the licence was to be revoked (2 year thingy) and it was the courts look out.

WTF mate?!

Ring courts, they umm and arr about it and tell me the DVLA should have sent me a letter to send the licence back within 5 days (never got a letter).

Police seem to think everything is ok...

Im pissed off and had enough.

Give us dates, you might need to take proper legal advice.

What date did you pass your car teast?
What date did you pass your bike test?
What date did you have the accident?
What date did you go to court?

If they are correct and your licence has been revoked you just need to reapply for it as a provisional and re-take either your car or bike test to get it all back as it was, could be done in as little as a few weeks if you pull your finger out.........

Does the new licence come back clean after being revoked?

Might even be to your overall benefit if it does. Pay for a test, get a clean licence.

Slightly off topic but when I sent my provisional away to get changed over it came back with no points on the paper part. It'll be 3 years sometime in the next few months. Do I still have them or what have they done?

Normally when you get banned, you get a clean licence back. Points are effectively fractions of a ban - get 12 (or 6 in some cases) and you get the ban.

Once you've served your ban, it's back to normal.

All well and good BUT you have to declare the BAN....!

If you don't declare it and you have any reason to involve the insurance then you will not be covered.
Its classed as Obtaining Services By Deception and you could get locked up.
The cops can and often do now, check with insurance companies if they feel there is reason to suspect an act of illegal anture has taken place.

Example : You are stopped riding an R6 and the cops do a PNC check, the check shows with DVLA that you had been banned last year but now hold a full licence again. So far so good, now they think its odd that a 22 yr old can re insure an R6 having declared a Driving Ban, the cops phone the insurance and they tell the cops that the BAN wasn't declared!
You will then be driving with no insurance and the 'Deception' charges will be brought into the equasion.

But a revocation of licence under the new driver regulations isn't a ban............ Confused

(Although presumably you would still need to tell your insurance as your licence status will have changed from full to provisional)

Yes, 6 points or above is revocation of the licence. You have to re apply for a provisional and pass the test again, your original points WILL remain on the licence for 4 years although only valid for 3.

So, you will get your licence back with 6 points on it from the 1st offence with the accident, 3 more points for the speeding so if you get 3 more your banned!

I'd say get a push bike until the initial 6 points are up.
