There's a 125 sitting outside my work rusting away for about 2 years now and I've been told I can take it if I want. A guy that used to work there quit one day, bike wouldn't start so he left it there to rot and hasn't been seen since. Is there anyway I can take it and get it back on the road legally?

There is some finders keepers law but I cant remember the details. Basically after X days of someone not claming something you can take it. I think anyway.

I would advise that you trace the owner and ask if you can have it along with the paper work.

If you just take it and do it up the original owner could in theory just demand you give it back.

Not just in theory, but if the original owner demands it back and you don't hand it over then it is considered theft. Just to add to the joy you won't be recompensed for any time/money spent on the project either.

There is something where you turn it over to the Police but register your interest in it, after 60 days or so it becomes yours legally.

Someone mentioned finding the original owner: The DVLA will release the information on the V5c to you under certain circumstances. DVLA link

contact the DVLAm with the frame no and reg no, requesting ownership documents.

They will contact the registered keeper asking their confirmation as to the change of ownership, and assuming they don't say they want to keep it, you should have a V5 in the post.

I've had this happen to me with a car I scrapped. I got a letter from the DVLA basically saying this chaps wants your car, what say you.

could take oit, do it up nicely and then the guy see's it, demands it back and the most you can do legally is take off the parts you put on, and hand it over, let the police & DVLA know, and take it from there and do a BCf search, tghere was a car thread a while back about this sort of thing. Cool

As far as the law is concerned.
The 'Registered Keeper' of the vehicle is not necessarily the 'Owner'.
This must be established by other means.
Receipt of sale/transfer etc.

Grey area.

This is the whole deal with the 'Ringing Trade'.

e.g.

https://www.autotrader.co.uk/CARS/buying/vehicle_crime_advice.jsp

The problem would be trying to register the vehicle for insurance or tax.

And then trying to speak to one of the bots who work with DVLA. Laughing

Is it on works property ?

Could find out who the owner is contact him and say you will take the bike off his hands or you will pass the large parking bill onto him. Or the company have requested the bike to be removed and its going to cost him £xxx to pay for said removal or you will simply take it for free, if he sends you the V5

If the guy just left it there I bet the v5c (logbook) isn't even in his name... Go to the post office (or you might be able to do it online) and get an application for a new v5c, it will cost you £30 or so (when you send it off), just fill in the boxes and away you go. As long as the bike is not reported stolen there is no problem. When the new v5c in your name comes through it will have the previous owners name and address on it as well, so if you need a receipt... the sig dosen't have to be perfect... and you know his name...

Wouldn't it come under "stealing by finding"? I'd be careful either way.

It's a scrapper cg125, straight from the 80s, so I don't think that's an option. Razz

It's been on their property behind a locked gate ever since so I'll see if they can get in contact with him and if that doesn't work I guess I'll have to try my luck with the dvla. That'll be fun. Neutral

I'm telling you made, just go to the post off icle to pick up an application for a v5c (form V62), or even print one out online by clicking here.

Read secton A of the guidance notes... act as if the bike was bought with no v5c. I believe the charge might be £19, but double check before you post it off.

I had to use one of these forms to get a v5c for my VW Scirocco, as the previous owner had never got the v5c off the guy before him, and so never registered it to himself!

Alternativly, where you you live/work? I'll remove it for free, and sell it back to you when I have a v5c in my name! Very Happy
