legal advice please?

ok my brother has asked me for some help and to be honest i am not sure of what it is.

he was caught speeding 102mph and has received his court date.

he has signed a box saying he will attend and is pleading guilty.

he has filled out the 'means' form.

heres the problems, what is the statement of mitigation for?
is it the bit where you write in your sucking up and point out how much your life will be ruined if you lose your license? or does he leave it blank and just cry loudly in court?

please advise..

If he's really not sure then go and see a legal expert... Most will do a free 30 min.
Or the CA might be of help. Or that website dedicated to helping you to aviod paying your dues for your crimes.

he asked me as hes not the sharpest knife in the draw mind you i aint a law student/grad so i went off with google and did some reading. that just screwed it up even more so i came here to ask.

- some sites state that it is only used by a solicitor to basically appeal a defendants plea if the sentence is too harse. (after trial)
- some state its where to put the information of the incident, why how etc
- some say its to plead for leniency ie excuses, reasons not to be sent down/lose licence etc.

so basically if you are in the know or been there done that then please let me know what you did with yours.

What they are doing is giving your brother the opportunity to explain his reasons for travelling at the speed at which he was caught.

For example, was he travelling that fast because of a medical emergency? If he had been in a car rushing someone to hospital, that would be a defence in law, or maybe there was some other reason.

By giving a reason that is believable, it mitigates the reason as to why he was speeding and can have a bearing on the penalty that is handed out.
