Well, pulling out from a side road onto a main junction. Traffic leaves it clear for you to do so. As you pull out (turning right) someone decides to make the single lane into two by pulling out to filter to the front of the lights. Pass or fail exam?

If you are emerging from a minor carriageway onto the major carriageway, you would fail on two counts, safety and legality.

First form failing to conform to either a give way or stop sign/line, 3 points and £60 fine minimum.

Secondly, for failing to give priority to traffic on the major carriageway.

Traffic may have stoped to allow you out, but liability still lies with the emerging driver or rider although in a civil case because of an accident, whilst primary liability would rest with the emerging driver, some contributory negligence would be levied at the filtering driver/rider.

Traffic may stop to let you out, but it is still upto you to ensure that it is safe for you to proceed.
Filtering is a well argued point on these forums and it is the responsibility of the driver pulling out to ensure its safe to do so.
I would also add that if its you filtering it is also in your best interests to ensure that if you see any gap in the traffic you are filtering passed that you slow down for just this reason that someone could pull out.

I would say it would depend on the examiner and the exact way you handled the situation as to whether they would deam it a fail or not.

Thanks for the reply. What happened was that the traffic lights at the main road were on red, and the traffic was backed up further than my junction, but leaving it clear for me to pull out safely, as the part of road was boxed keep clear. So I pulled out, doing all my checks, and then as I was about to straighten up on the main road to proceed, the car decided to jump the queue.
