Right, well after 4 months ive finally got my summons through the post. I was pulled on the 4th of april, and have since been hoping that the copper just wanted to scare me shitless. However, this is not the case, and id just like to thank that AR$E in the unmarked subaru for doing me, top bloke.
I was caught doing 89 in a 60 overtaking a queue of cars all doing around 60. Nothing coming the other way and was trying to catch up with my mates as i was in the middle of yorkshire and didnt know where in hell i was. So i finally catch up with them and see flashing lights in the mirror.
I found a safe place to pull over and he seemed like a nice enough bloke, i was polite, courteous. Took my helmet off and provided all my documents, tax, MOt, Insurance, licence.
Then today my summons came through, ive got to go to skipton magistrates court ( dont know why i couldnt just go to preston ), on the 28th of August, so im going to get as much riding as possible in between. If i lose my licence i have to move house and if i dont i'll lose my job. Im really hoping they just give me points and a fine.
Biking is my life, i really dont know what id do if i couldnt ride for x number of years, its my first offence and im just hoping it isnt the one that gets me banned. Im really dreading the outcome. I dont know wether to just do a guilty plea via post. Or too go their in person. Has anyone been in the same situation or a similar one?
A truly gutted fenton
on the plus side i think i may have had the fastest ive ever been on my bike when its restricted caught on camera ____________________ PEANUT BUTTER JELLY TIME!!!!! I cannot be held liable for anything that i post.

30mph over the limit is where you start getting buggered iirc, so you're 1mph safe! good luck ____________________ www.bikepics.com/members/jackcheese <--- NOW FOR SALE! 51 Plate Cagiva Planet 125

There was a rough mastristates guide on here, or a link about the fine/speed ratio and what you will most likely be done for, Can't find it though. Good luck anyway mate. ____________________ Roger wrote: Women don't get damp for clingy puppies. Get some better happy pills, hit the gym & buy a medallion the size of a dinner plate. Job done |

Dont worry about loosing your license it wont happen , i got pulled for 112mph on the M56 , that went to court , i pleaded that id loose my job , just moved to the area , nobody to rely on , should have been an automatic ban at 100mph+ , i ended up with 6 points and £400 fine and never lost the license .
You are looking at 3 to 6 points and a fine so youre safe
But hey pretty dam good first offence |

The speed you got quoted at is unlucky as ACPO guidelines say up to 85mph in a 60 zone is fixed penalty. Over that it's a summons. So you can slag the officer off as much as you like (feels good anyhow ) but probably out of his hands once speed recorded on piece of paper.
The magistrates guidelines (from Pepipoo) says 21-30 mph above in a 60 zone is 4 or 5 points and disqualification not considered. However, these only guidelines and magistrates can differ (based on what side of the bed they got up or whether they got laid the night before I guess - well that's my understanding of consistency in British justice ). Fines can be up to £1000, but if I remember right you fill in a form about your income and can maybe pay these off in installments.
Advice about appearing smart, suit + tie help, is worth it as it makes you look like the magistrates and different from the hoody wearing chavs they normally see. Solicitor may advise but IMO if asked anything best to apologise saying a genuine error. Don't say playing catch up or didn't know the speed as this can be interpretted as bad driving/riding. Don't get sucked into describing your riding, it's a speeding offence. If your riding was suspect you'd be there for dangerous driving.
If you haven't spoken to a solicitor try and find one with traffic offences experience (a lot don't) and see if a free half or one hour session is available and will help.

SO should i go too court then? there's a bit in the summons about pleading guilty via post. Then they decide what you get, and if they are considering disqualification then they will have another court date which you have to attend.
Cant really be bother to go to court, but will it help, ill have to go see a solicitor next week and see what they say.
YEah, twas a pretty good first offence imo.

IF you've been summonsed it's already past the fixed-penalty stage so I think you should go to court, dressed smart and being polite. Explain that it's you're first offence, that you were on a group-ride and got left behind and was executing an overtake so as not to get lost. Admit to your speeding but state that you were doing it with caution and giving consideration to the other vehicles on the road etc. Finally tell them what the consequences of losing your license & job would be for OTHER people if you lost your license. If you have no dependants I'm sure you must have a poorly or elderly relative that you visit every Sunday and do a bit of housework or shopping for ____________________ a.k.a 'Geri'
