Woman in a merc big 4x4 pulled out into me today Crying or Very sad and i went flying into a parked van Crying or Very sad My bike is in a right state and ive just come back from hospital with serviour abrassion and left leg and arm Sad The woman who did it started crying saying "i didnt see you" police came and checked bike. Ive rang insurance and there sorted it out with both my bike and injury claims, only thing is now shes said i was going fast but i have a witness at least and he says that if i was going fast i would have seriouser injuryies and he would have heard me coming as he had his back to me meaing that he turned round when it happened Wink Hopfully it should be ok though, and ive got a tempary bike sorted with my insurance as ive got my test in 2 weeks so its happened at a bad time Laughing just thought id share my expirance

If she saw you 'going too fast' why did she then pull out? That excuse is useless.

Good luck getting it sorted.

Ouch, least you came out the other side in relatively one piece Thumbs Up

How bad are the lower fairings? The nose cone isn't too expensive to replace so you might not have it written off.. if the lowers are gone then that's probably gonna be an un-economical write off.

Hopefully the too fast thing will be thrown out as crap. If she hadn't seen you how can she know how fast you were going?

Not seeing him = careless driving.

Seeing him and pulling out = dangerous driving.

All the best

Unlucky, sounds frightening. A woman driver AND a 4x4, did you get the shitty end of the stick or what?

Is there anything you can learn from it?

I had a low speed off, I put my front brake on and the front wheel just fucking went... Now I check my tyre pressures once a week, I weigh up road surfaces ( especially at junctions where cars have to wait for other traffic eg leaked oil and crap ) I change down and use back brake if I'm unsure...

Bikes are fucking great. Chalk it up and don't let it put you off. Good luck getting through the mess the stupid bitch has created for you.

Ouch, your poor bike looks like mine did at the end of April, only I bent forks, fairing bracket and smashed headlights, and ended up with broken wrist and foot.

hope you and your machine get better soon. Keep an eye on ebay and bike breakers for parts, Good luck

If she said she did not see you .... How can she know you were going to fast.... Police will soon sort that one out.
Sounds like she is looking for a way out.

From pics it dont look too bad, but why is rev counter showing 3K ??

The fact she says she didn't see you, and then that you were going too fast is quite hilarious.

thats wat i though seems pretty daft, shes just trying to see if she can get out of it but i should win as everything seems to be in my favour. At first i felt bad as she had kids in car and she obviously didnt do it on purpose but now shes said that made me furious so im claiming for both bike and my injurys from her insurance so i should get some compensation aswell

You realise from your comments that your witness admits he didn't see the accident happen?

A padded jacket and trousers, im going to obtain leathers but i didnt feel it was neccessary on a small bike. Yes the person at the accident admitted he didnt see it happen but the police asked if he heard me coming and he said no and he couldnt of been speeding. As he had his back to it untill he heard the impact. Hopfully i should win.

Car drivers nearly always say bike riders "were going too fast" because they have pre-conceived ideas about bikers that gives them a biased view.

All you have to do is ask "how do you know?" and they are stumped.

If they saw enough of you to judge your speed they shouldn't have pulled-out - their fault.

If saw you but didn't take time to judge the time/distance they are guilty of being careless - their fault

If they didn't see you because they didn't take time to look properly - there fault.

Mostly it's just denial, they don't want to admit that their stupidity could have killed someone.

Thanks geri shell be just saying that as she doesnt want to admit her fault but either way its her to blame so i just need wait and see what happens, my insurance are ringing me back on tuesday so they will pick up the bike and access it which i think is a write off as steering is broke aswell as all the costs for basically all the cosmetics, plus clock dail looks broke as rev counter is stuck, plus the little things like my indicators and foot protive panel thing which covers up some of the wire where footrest is is also broke. How much money about will they give for a write off if anybody knows. Will they give the price what i dealer would of taken before the crash or a average private sale price? or summat else? would be great help thanks

They should give you what the value of the bike was before the accident, then you should claim for any injuries and damages to clothing on top of that.

I'd double check the skid lid, may look ok, but if it impacted something then I'd get a new one, better safe than sorry.
