Hey guys,
Ok.....on the 10th August i was caught speeding, the copper said i was doing 71 in a 30 and he used a vascar 5000, i know i was going over 30 but NO WAY was i going that fast, he pulled me over anyway and asked me what the speed limit was he never said anything about doing me for it or anything and he never gave me a ticket and then let me go, i thought i was lucky but then in the post on the 30th of August i got a court summons to go to the mags, however the time that is on the court summons says i was pulled over at 5.20 however it wasnt it was 5.50 because i looked and i have video footage of me leaving work at 5.30 so could not have been speeding at 5.20! Is this like a technicality i could use to get out of this, i know i was speeding and its wrong but anything i can do to get out of a ban i am going o give it a go. Any help will be great as i dont really have a clue what to do. Cheers guys!!

I think you could be in the clear there, I got out of a parking ticket because they had the wrong date on the ticket so I would assume that this would work along the same lines.

You can prove that you were not pulled over at 5:20 this calls into dispute all the other information provided, if the officer admits he put the wrong time on the ticket not only it begs the question what else did he get wrong.

Looks like someone can not read the guys 2 & 5's........

Get your video footage saved to a disk/tape. Also any clocking in/out info. It could just save you your licence.

Fingers crossed you lucky lad.....

Now as the Nazi's say.... SLOW DOWN and think of the KITTENS.....

Get onto PePipoo and ask there as there are people that know what they are talking about and if you stand a chance of wriggling your way out of it.

If you were doing 71 in a 30 its a ban usually anyway.

did a google for you, came up with this, hope it helps a bit, there is a specific question about wrong time on NIP, and nothing to do with clocks going back/forwards. get the evidence of you being in work at that time and make sure you keep it safe

Good luck with it Smile

Now I would guess this would come under 'de minimis' or so small it just doesn't matter.

What it could be used for is to cast doubt upon the police officers testimony. If you can prove he was wrong about the time it may cast doubt upon his other evidence but I wouldn't be relying upon it.

It isn't a NIP he's received its a summons. Different kettle of fish.

Sorry for getting it wrong, but I do agree, there is a chance of 'getting away with it' as if time is wrong what else is wrong?

get some legal advice though before you go to court
