Had my first off a few hours ago.

Car garage with the 2 usual entrances at either end, car in front of me turned left into the first entrance, ahead was clear, checked my mirrors as someone was right up my arse [just came through a junction] then the woman is tapping me in the side look up and there is a nissan micra pulling out.

Swerved right but the front left of her car got us - slammed onto the ground I rolled and came up ok, woman hurt her hip and we were both put in the ambulance where I was breathalised [I dont ever drink] and that was that.

Girl driver turned up felt like 2 minutes and said "sorry sorry sorry im so sorry I just didnt see you".

I wanted to stay and get witness names and addresses because I know how this lark works after reading here... Didnt get chance to as I was driven off in the ambulance with the better half - waiting on a police officer to ring me now.

Bike could be fucked, didnt get chance to check it over too much but there is glass and fairings on the road driving back and at the time there was petrol flowing freely from the bike with smoke coming off it...

I was heading southbound...

I have no details, nothing from the police yet [went to the cop shop after hospital it was shut with a note saying "shut - ring number Rolling Eyes " Police woman said she'd get the PO to call me. I haven't spoken to insurance yet, no pictures of the crash from my side and I have no details...

Any advice much appreciated.

I was told the police officer who was first on the scene will ring me, but finishes at nine.

So I rung up a minute ago getting anxious to hear from him cus he is buggering off home...

After a little asking about it turns out they have the police officers name wrong and the real one signed off at 5pm and will ring me sometime on Monday. Got my name wrong and got the road on which it happened wrong as well... Rolling Eyes .

Set that straight then ranf the road traffic unit for more information - no one is answering so rang the recovery garage, they have the bike but can't tell me what state it is in, or how much it'll cost to release.

Fingers crossed the girl was still in "truth telling" mode when the police arrived and hasn't decided to say something like "He was speeding!"... Sick

Rang insurance they will speak to me on monday...

Ring the insurance as soon as you can, the recovery place will be charging a fair amount of money from the second they picked it up.

There really isn't much else you can do at the moment. Make sure you write it all down while its still fresh in your mind. Make a note of injuries, taxi fares, etc, it will all come in handy later.

Only other thing I can think of is if your in the RAC or similar ask them if they will collect the bike and bring it to your house. Not all of them will but its worth a try.

Thanks - the bike was recovered whilst I was in A+E apparently by some contractor for the police who can't tell me anything.


Went back to the crash in the car and there is absolutely no doubt she was in the wrong now, you could piss across the distance between the two entrances. There is sand and grit laid down where the petrol had been pouring and a few select pieces of fairing left which I hav recovered - probably can't prove anything or do anything with those yet though. Will write down things as you suggested though thanks. Already got my first taxi receipt and receipt for pain killers from the hospital. Neutral

Will keep the thread updated as and when. Crying or Very sad

Poor obs. Did you not see the Micra? If not, were you riding too close to the car infront? If you did, why were you checking your mirrors for what was behind you when the danger was infront? At petrol stations, you should anticipate people pulling out so should be prepared to stop in a controlled way.

Actually no in all honesty I think I was fine, clear junction lights weren't changing and I wasn't too close to the silver car.

In fact I was half thinking about overtaking it but I didnt as I was far enough behind to see there were cars coming ahead for quite a way so thought better of it. Car pulled out to the right slightly and then went left to fit in [was a citroen picaso or something similar].

Ahead was clear, [didn't see the micra] checked my mirrors as the speed had changed letting the silver car in looking in my mirror for about half a second or so and then I was being thumped - saw nothing but a red bonnet in the middle of the lane, tried to get around it and then everything went sideways.

I was up straight away and checking the other half over but all the damage to the car was on the front LEFT, in other words I made it past the car and it continued into me.

You can say "Thou shalt notice cars approaching junctions" but in a matter of a few seconds there were 10 places with cars emerging, coupled that with my rear check which I felt necessary as the car in front and then me were slowing down... Just one of those things.

I don't hate the girl who knocked me off or anything, she was turning left and saw a car turning in and probably just looked left and went for it. I think if I am honest I would have done the same thing as her if I was driving - just a bad cumulative effect of that particular time and place.

To summarise, traffic was slowing down, ahead was clear and I checked my mirrors, look up and then I had about half a second to get round - I must have got round to some degree and neither me nor the gf was hurt. But thanks for your support anyways Wink


EDIT:> Just remembered that lane is usually the turn right lane, it makes perfect sense now.

She looked right, saw a silver car indicating/turning in, looked left and got waved in the northbound lanes, probably said thanks looking left then went for it looking for the gap - then hit a bike that "came from nowhere".

My perspective was silver car indicating left, pulls to the right then manouvers left into the garage, I see a clear road ahead but missed the micra [maybe it was behind the silver car when I looked for it] checked my mirrors and then hello mr bonnet.

Just realised when I go to Uni next week I will likely lose my job as I work 6-9 and now will be pedalling.

£20 Painkillers prescription
£20 Taxi fare
£70 Lost wages for the gf

Then I have to cough up recovery of vehicle and then in a weeks time I'm gonna lose my job... Cost's a bit this crashing lark.
Then as of next week I'm gonna lose £300 a month and

Insurance person rang today - told them what happened briefly and she mumbled something about her coming across my lane it's her fault.

They wont do anything until I get a police report to them though which I have to get apparently, so that'll be happening tomorrow I hope, gonna check the bike out tomorrow as well - good news is she said I would get a hire bike but not til the report is in and depending on the force they can make that take 6 weeks...

Oh well the good news is that I paid £20 odd squid for legal protection with them and have £50,000 expenses covered so I intend to use them to get new lids and gloves etc along with the taxi fares and what not.

I'll get pics up tomorrow hopefully.

As long as you hadn't actually pulled out to overtake the car that was turning infront of you, you should have no problem with the insurance laying all the blame at her feet. Smile

Sorry to say it, but it was poor obs' on your behalf though, you should have seen it coming and avoided it. I usually find when in that situation, It's better to be concentrating on the traffic ahead rather than what's behind. That's easy to say and most "accidents" could be avoided with the benefit of hindsight. At least you'll know for next time...... Wink

True true, got the registration of the girl who hit me now [although nothing else as the PO is playing AFK all day].

They traced the registration and she is insured at least.

Damage isn't so bad afterall.

Ignore the tax disc - I keep the real one in my wallet. It's being rescued tomorrow and brought to my local mechanic for him to have a look at.

I agree whole heartedly but I had just come through a set of lights and then slowed right down for the silver car - I live near preston and let's just say the majority of car drivers here don't seem to realise what a red light means. I already had one person just randomly drive into my back end once at a junction - but I do appreciate how it sounds all this when reading it back.

I might go get a picture of the garage later and stick that up.

Officer then said he needs ot see me for a statement on friday etc and not to worry too much about it, said by the glass on the road and position of my bike I was estimated to have been riding at approximately 15 miles per hour and in the correct position - there is thank fuck an indepenent witness as well who is said to have told the police I was riding along normally and then she lurched/jolted out and then hit me.

Denying liability... Neutral

I don't know how people think they can get away with it. Sick

Blame the insurance
Most of them say on the top of your policy, or in the booklet

"If in an accident do NOT under any circumstances admit liability"


If it isnt a black and white case they will get it knock for knock. Roundabouts are a good one. Pull out so someone hits you on a roundabout with no witnesses. Chances are they will end up claiming on their own insurance. Smile


Hope you get it sorted, an independant witness is a good start. and if the police man agrees with you then fingers crossed for you. Smile

Forget all that. In an accident that is plainly not your fault, get onto one of the accident support companies and you'll have a bike tomorrow (and they will deal with the police and insurance companies for you):

HelpHire
Accident Exchange
Bike Crash Line
Rider Support
Biker's Legal Defence

The most it will cost you is a £10 fee to insure you against the other company failing to pay up for your car/bike hire. Their fees are recovered from the other party (and are in addition to any personal injury fees that are awarded to you).

I've used the first two this year.

Thanks guys - I was phoned up today by Biker's Legal Defense who have been isntructed to sort me a bike out, gave her some details and the woman is gonna take some more tomorrow as [something] was closed now but I'll probably get a hire bike tomorrow and it "Will be something of the same size as what you were riding".

So i'm guessing things aren't looking so bad now, at least compared to when I started this mess, not knowing if she was insured, if the blame was gonna be levelled on me or if there were any witnesses.

Pain in the arse though ain't it.

She will have spoken to friends etc who will have told her to call ins and say it was not her fault. As you have said Police have backed your side.
Next she will say you were speeding.....

Got back from the doctors a little while ago and he tapped me with some things and played with my back - my neck muscles and under my jaw are hurting like hell now.

Not like agonisingly bad but it's making sleeping hard - he said I have para-spinal muscular spasms or something wacky like that and gave me some diazepam.

Funny because the gf was thinking she was going to need treatment as she really was out of it this morning with forgetting things and feeling sick and when she was driving she was going to go through several red lights until I stopped her!

So she isnt driving anymore and got the all clear despite being a bit of a mong - whereas when we crashed I hit the ground and rolled and wa sup straight away and felt generally fine on the day but now im feeling pretty ropey and the doc wants me in next week with instructions to come straight in if I get any *list of symptoms. Neutral

Will get some pictures and information on what got broken tomorrow when my local mechanic get's to it.

On a separate (but actually very related) note, is it legal for a Learner, to take a fully qualified rider pillion on a bike with L's?

Bikers Legal Defense were assigned to me for my hire bike after a crash I had last year....

They gave me a VFR for 2 months..... the whole thing has now been resolved but the 3rd parties insurers are kicking off at my insurers because the bill for the hire bike came in at £5960 for 2 months, £1000 less than the value of the bike I had that got written off by them... its nowt for me to worry about anyway....

they seemed like good peeps... a Van came along and dropped it off.... and they picked it up 2 months later..


oh yeah, I presume from the micron sticker that you have a can on the bike? make sure you remove any non legal or anything on the bike you havent told your insurers about as it could cause problems and depending on your insurers they could play silly buggers..

Got the bike back to my local mechanics today - had a cursory glance at it and said it's fucked.

Front fork has a hole in it, front wheel is cracked, something to do with the fan has been rammed inside the radiator, steering is shot and then the usual shit on the side of the bike that goes walkies. And this is before he has actually properly looked at it so...


Didn't get pics as I forgot my camera - Bikers Legal Defence rang me and asked how I was I said I was meant to be off work for a week and then they promptly said they wouldn't give me a bike as I was unfit to ride - which pissed me off a little but I suppose is fair play. I don't NEED one til next week anyway.

I just want to see this copper badly now on friday and find out what the score is with the witness.

If this goes my way [which I expect/hope it to] can I sue her or something for being a pain in the fucking arse? Well, do her for being a lying toe rag and causing injury and what not. Or does the insurance claim do all of that in one go?

I was feeling alright about her for a while but at the time she fucking knew it was her fault and was begging for mercy saying sorry etc - for all she knew she could have killed my gf and she wants to say it was my fault or something? I want to take the gloves off now. Evil or Very Mad

It's just a slip on and road legal apparently - went through on an MOT and I insured it with it on.

Went and spoke to the police a few hours ago - first chance the officer on the scene had to see me.

He is doing the car driver for care and attention and telling her she wants to plead guilty as the courts will see it as an open shut case. I read half the witness statement and they said I got done over basically.

I'm feeling a load of weight off my shoulders now because I know I didnt do anything wrong you know but still worry anyway. Apparently one old woman said I was speeding but then admitted that she hadn't seen anything when questioned... Mad.

Wow, sorry to hear that you had an off, and glad to hear that both of you are (relatively) OK.

It looks like she should get the book thrown at her....she was probably looking into the lane on her left, and pulled out without looking.

Remember to claim for your riding gear as well...2 x helmets, 2 x jackets etc etc.

Good luck...and get back on the road soon!
