Well, couple month ago i received my first 3 points for speeding doing 43 in a 30zone, bad luck, got captured by the unmarked police car...

This time it's even worse, i was coming up to the only decent bit in my town where you can have some fun, so i looked straight and there weren't any police cars no where arround, there were only 1 guy on the scooter and a scoda so i thought i'll go for it, so here we come my 10seconds of adrenaline... 30seconds after looking in my back mirror i can see the scoda car with it's police indicators on, shiiiit...

I stopped and went for a talk in his car, he had a video of me flying past him doing 53mph in 30zone, because i am a learner he said he cannot aword me with any more points Very Happy but the letter to the court, he said they going to write back to me inviting me to the court, well, he said i am might going to get banned, may be not and after taking my details he let me go...

I am sure there should be people arround with similar experience so i just want to find out the concequences of what can court say, one guy told me they'we made him retake CBT...

Magistrates tend to frown upon speeding learners, especially those who have previous points for it.

Fully expect to lose your licence and have to retake your CBT. If you keep your licence consider yourself very bloody lucky and dont be a fool, keep your speed down whilst on L plates. We cant all be Valetino Rossi....*

For past 6 month i learned a very valuable lesson: speed limits are there for a reason... I am fully ready to take any punishment i will deserve, i just want to know what are the possible punishments would be...

He was wrong. The 6 point limit only applies when you pass your test. So you could have 6 points on your provisional, pass your test, then be on 6 points. If you get any more points in the following two years yo will have to retake the test.

But if you got say 9 points on a provisional, surely you would instantly lose your licence the day you pass your test.

You could even have 9 points on a provisional, pass your test and still have 9 points on a full license within the first 2 years (but get even 1 more point and you'd be banned).

Can anyone find an official website where it says so? Because if i do have 12 points (which actually doesn't sounds right for a provisional) i might be lucky to get away with 3-4points around 80quid fine... I am really confused now

You might well get away with a handful more points, but 53mph in a 30mph zone is quite well above the limit. I am not sure the exact powers that a magistrate has but I reckon that with your learner status, the speed you were caught and your previous conviction that they may well be within their rights to ban you from the roads for a short while.

for 30zone it's 51mph of maximum for fixed penalty, well i got clocked by 53mph

Hi

As above, it is the act of going to 6 or more points within the first 2 years of your first full licence that results in it being revoked (not a ban). If you already have 6 points when you pass your test then you have a full licence but any more points at all and it is revoked.

its not this bit that will be bad its the next four years when you have six points and are trying to pay for the insureance which in my case was bumped up by a grand even with two years no claims and having a full licence for 18 months

That is because the new drivers act does not apply to provisional licenses. Hence the 12 point limit applies (although that is 12 points and you get a ban rather than 6 points and going back to being a learner).

The 6 point limit does not mean you are banned, just that you revert to being a learner. Which doesn't really mean anything if you are still a learner.

Read again. Section 2f clearly states former points only come into play when you are receiving points for an offense committed following passing your test.

Legally, you still have 12 points to play with on your licence and until you pass a drivers test the New Drivers act will not apply to you.

Chill, put your bike keys down and grab a beer. You aren't going to lose your licence this time. However screwup once n the two years following your first driving test and you will have to ask for your provisional back.

Unless the magistrate is having a bad day. I think you'll find they are perfectly entitled to hand down a disqualification of several months if they feel the offence warrants it.

Short Period Disqualification - up to 56 days, although they seem to like handing out a week for Motorway offenses.

If memory serves they can't hand out an SPD and points, although the SPD stays with you for 4 or more years.

I'm sure the magistrates guidelines give a trigger speed of 101mph to work too, although I can't find any evidence of this at the moment.

I must say, where on earth are you? 53 in a 30mph zone really is asking for trouble, especially so on a noisy bike. Surely you must have some faster roads nearby that are good for a blast? I can think of plenty of roads within 20 minutes ride of me where I can pretty much ride as fast as I want without putting my license or anyone else in danger Thumbs Up
