a few of you have requested how my story came to light regarding my accident, below is my account of it which i posted on another website. please bear in mind i was disabled before my accident and now im left with significantly more disabilities here is my account..


Dear Readers,

I write to you to inform the law abiding drivers of Wigan & further afield that the Law is a complete waste of time for a crimes victims, In June this year I was out on my motorbike with friends, we had a pleasurable ride out over to Southport and came back to Ashton Via Liverpool M57 & the A580 East Lancashire Road. At around 9.45pm we had got to the traffic lights outside Ashton Golf Club heading towards Ashton Town centre 2 mins from home. The traffic lights were on red I was 1st in the queue of traffic with a friend on his bike behind me followed by a line of traffic all waiting for the lights to turn green, opposite me was a line of traffic also stationary waiting for there lights to change to green.

As they changed I moved off with my friend close behind me as I got just under ½ way across the junction the front car heading towards me suddenly without indication swerved and cut across my path turning to her right (MY LEFT) the last thing I remember was my face hitting the cars windscreen. After several weeks in hospital and 3 operations I was let home. But I came home using a wheelchair and losing the use of my right arm and left leg with more surgery due, The police which in this instance was Merseyside Police Force, as the accident was just in the boundary of St Helens attended the scene and followed my progress over the next 3 months. I was then told by the investigating officer that the young female driver from Garswood who had only just passed her driving test the day before she hit me, was not going to be prosecuted because in his words” It would not be beneficial to the young girl as she would get an instant ban and be made to reset her driving test after her ban”, So in there wisdom they want her to go on a 2 day driver awareness course. I feel I have been cheated out of any justice as I am the victim left with now permanent disabilities 2 plates and 14 screws in my arm and shoulder extensive soft tissue damage to my left leg including ligaments and cartilage damage all due to this young girls recklessness. Followed by months of physiotherapy which will be on going for a long time.

The police were more interested in making sure the young girl was not put of driving the fact I’m now in a wheelchair and need care and help getting dressed bathing basic needs simple tasks like cutting my food up for me, won’t be able to ride motorbikes or drive a car again does not count. As far as I can see if I had caused the accident as a motorcyclist I would have been railroaded by the police.

I feel very let down and very angry at the injustice. The Police Officers final words to me were as follows “Just think of the insurance payout at the end of it all” So that makes everything ok.

so were you both stationary facing each other at the lights? Do you think she knew you were there? Did she randomly swerve into your path without any warning? was she in the lane waiting to turn right? were your lights on? Were you speeding?

Sorry for the interrogation but these were the questions asked in the previous thread, and we still don't know the answers. Hope it doesn't seem intrusive and no worries of you cant remember it.

I cant believe the attitude. If she had done that on her test the previous day it would have been an instant failure for lack of observation and dangerous driving. The minimum the police should prosecute her for is driving without due care & attention (which is easier to prove than dangerous driving).

As for the payout - it is going to create an arguement by her insurance company that as she isnt being prosecuted she hasnt done anything wrong so why should they pay out!!!! I had that arguement following my accident and the other party was prosecuted so hate to say it but good luck and I hope you dont have this problem with her insurance company.

It was Ashton-u-Lyne? Where abouts were these traffic lights because I'm imagining it was at Hurst Cross?

yes we were stationary both at red lights facing each other.she claims not to have judged the distance i was at from the impact point she definately saw me. she swerved infront of me turning to her right my left. my lights were on. i was doing about 15mph the distance from my start position to the impact point was 34ft the distance from her starting point to the impact point was 85 feet u make your mind up as to who was speeding. just as a point of interest her boyfriend was driving in a car right behind her. several witnesses said it looked like she was trying to beat the line of traffic to leave her boyfriend behind waiting in the queue

Wheelchair or no wheel chair if some arsehole copper said that about the insurance pay out I would have smashed his skull in, and but that fucker in a wheelchair no amount of money is worth the shit you appear to have gone through.

I'm not sure of the penaulties the girl should get for what she did, personally I don't thin I would hold it against her (although I'm not in your situtation) I personally do not believe the girl should be punished because you got hurt as such, she should be punished for the act not the consequences.

I really feel for you mate good luck and GWS.

her insurance company have already made interim payment as she has admitted the accident was 100% HER FAULT

Am glad they have made an interim payment, I know it doesnt make up for the accident but at least you havent got that arguement (& stress) to go through as well as the recovery.
