I'm after some help to clear up a little issue that I have with a person who will remain nameless.

This person like to buy mushrooms from Tesco, not the pre-packed ones but the sort that you bag yourself. What this person does is put an expensive mushroom into the bag first, then put a few of the cheap ones on top, so that it looks like a bag full of cheap ones.

When I pointed out to this mushroom thief that it was, in fact, shoplifting, the accused stated that it wasn't shoplifting, it was shop assistant incompetence as the checkout operative should check each mushroom in the bag to ensure that the contents were all of one variety.

BCF Jury, guilty or not guilty?

What owdamer says, it's not as though some mushrooms will make much difference to their annual profits.

So theft is only theft when it's on a large scale?

I'm only talking in general principle here, I'm not talking about this person going down for it.

It's quite obviously theft. Without going into the tired old arguments (where people justify stealing by yakking on about evil corporations in a Captain Planet-esque fashion) about the rights and wrongs of theft - lets just agree to be honest and call it what it is.

He is intentionally using deception to permanently deprive the store of goods or services that he has not paid for. He is thus a thief - and therefore a criminal. That he tries to argue the toss simply shows that he realises this, and is trying to justify himself.

It's immoral, I wouldn't say theft as he's still effectivley paying for said mushrooms just not the whole price...

10/10 for effort though... Thumbs Up

He is knowingly taken something that he hasn't paid for - with no intention of paying what he owes.

Theft, plain and simple.

Just as a matter of interest how would you compare this to what littlewoods do when they repackaged returned items and resell them as new? When you buy something from them you are generally paying a higher price than you would in a shop, yet they are sending you used goods.

Fraud probably breaking the trade descriptions act, alot of people would not notice , except maybe for PCs I remember a watchdog report where hardcore porn was found on the HDD of a prior owner.

This actually (to the OP) happen alot at school people would hide pies under large piles of chips.

Interestingly how does one class tomatoes and brocoli? ,

A girlie I used to know in Plym used to remove the green bit of tomatoes the remainants of the vine, and the stalk off the brocoli, you aren't taking it , thus you aren't paying for something you haven't taken theft or not?.

My dad when he isn't somewhere in SEA is notorious for snapping ginger.

Edit the solution is of course just not to buy from supermarkets who are always more expensive than open air type independent markets who operate in perfect competition and thus keeps prices low. As said with tomatoes 6-7 cost £1 in a super market a box of about 50 costs £3.

yer pays yer money yer takes yer choice...

I was a little shit when I was younger and used to steal chocolate from the local stores.

Anyway, I inevitably got caught one day and the store worker grabbed me by the arm and forced me to stay in the store until the police arrived (I was 13 at the time, she'd never get away with shit like that today).

Luckily for me, one of the officers that attended used to live across the street from me and knew myself and my family very well. He took me home, my parents gave me the talking to of a lifetime, and it put me back on the straight and narrow. I haven't so much as stolen a penny sweet since that day.

Rehabilitation apparently does work, but only if the parents take an active role it seems.

this is precisely why internal damaging punches need to be learnt by many people, a Welsh guy in School used to use it on gits who crossed him, they'd be really badly hurt but not have a mark on them.

mortals have to use a telephone book and a hammer though.

Theft plain and simple. By hiding the better mushrooms under the cheaper ones, it is theft by deception.

isn't that sort of what tescos do when they put all the older bruised mushrooms at the top of the stack. If you want the fresh white ones you need to rearrange all the boxes!.

That's lightweight. I snap off the stalk of Brocolli. I don't eat the fucker, why should I pay for it? If there are no loose fruit and veg left I will happily tuck in to the organic fair trade leftie clap trap hand wringing crap and slyly put them in a bag whence I get round the Mr Sheen.

Won't someone think of the Africans!?

Nope, not Harold_Shand who buys Tesco's own battery farm eggs to save 50p ( That's almost 3 tins of Plum Tomatoes ).

I have a love/hate relationship with Tesco's. If you are on the ball and spot where they have put their prices up that week, you can take the cunts to the cleaners. I treat the weekly shop as a game, me vs Tesco. The cat food I buy is expensive... £12 for 3kg, but it's the best and my cat loves it, so I buy it. Picture my delight when it goes down to £7. Fucking great, but they didn't make any song and dance about it like they normally do, nothing. Then the next time I need some, it's back to £12. They change there prices like 2-3 times a day, love em or hate 'em, Tesco's is some fucking organisation and theie success should provide us all with some moral high-ground when choosing to shoplift.

Aren't they weighed and the cost then calculated at the till by type? think at Morrisons they do, they press what it is on the till and then depending on the weight its calculated. So if theres a heavier 'different' type of shroom in there they'll end up paying whatever the weight of that is in the equivalent smaller ones.

I'm taking it most places use a sticker system though, weighed before then a price sticker done yourself on a machine? like bananas are with the bunch clips, they can just be swapped over for a pre-done cheaper one.

Know as a little scrote I used to start a pick n mix get the price label after weighing and add in 'extra' hope the cashier wouldn't notice the extra, which in turn is theft as its intentional like mushroom man.

When we returned a microwave to Tesco we stood near the stack of them which were the higher wattage rating for £10 more, but in the same box with a little sticker at the back...we was hoping to get a swap on one 'accidentally' of those but they checked the stickers Laughing so if they wouldn't have checked they would have lost out for not looking in this case Thumbs Up

Not quite the same thing is it. Rolling Eyes
Don't get me wrong, I'm no fan of Tesco, but rearranging their stock cannot be compared to the actions of the thieving scrote mentioned at the start of the thread.

If the shop assistant / check out person spotted this then it is an 'Attempt Deception'... It is only a deception if the staff fail to notice it and the suspect pays for a cheaper mushroom.

Theft is dishonestly apropriating an item belonging to another with the intent to permanently deprive the other of it by keeping it, destroying it or fencing it.

If payment is taken then it is NOT theft as such.

Now, if it was a self service till such as Tesco extra has at night it cannot be deception............you cannot deceive a machine, it then becomes obtaining property by percunary advantage.
