Dealer fook up, what are the legalities here?

Bout 30 mins ago a lady i know knocked on my door, she had her 50cc scooter serviced today and wasnt happy.

After leaving the dealers at 6pm she fell off the scooter twice while applying the front brake.

During the service she had an oil and filter change and spark plug etc.

I took i t for a quick lap round the block and it was evident there was something wrong at the front end as every little bump felt like hitting a huge pothole!

I checked the tyre pressures to begin with, the rear had 32psi, and the front had nearly 65psi in it!

Now she says that the tyre pressures were fine when she took it to the dealers. If the dealers did inflate it too much would they be liable? There is a fair amount of damage to the right hand side of the scooter, and she has wrecked her jacket.

The dealer is quite a major one round here, although ive had a few problems with them in the past they are meant to be quite good.

goto the dealers first and speak to them and tell them whats happened, give them a chance to sort it out. If not start shouting and screaming and threatening to soil their good name.

65psi...fook me! that must atleast twice the amount that is needed!

surely they must be liable, and what sort of mechanic would have done that and not realise!

Is there anyway she can prove that she did not inflate the tyres to that PSI. This is going to be the first thing that the garage will say. If you can prove she didn't and more importantly they were liable then it will be easy. Good luck Thumbs Up

Go to the dealer ( with an independant witness) and ask them if they checked the tyre pressures at the service, do not say anything more.

but they might know that this is inadmissible evidence in court unless it serves the public interest (ie that dodgy doctor who sold peoples organs). And thus call your bluff , its why most telephone services state the call is being recorded.

The front tire on a 50? surelly it has life expentency that is longer than the engine!

Just spoken to her again, the front tyre was not replaced. She has been back to said shop today and asked them about it.
as far as i know she is waiting for a phone call back from them.

I will let you all know what happens!
