After the case being adjourned 4 times i finally got a date for trial (today). I had no solicitor and just a bit of help from my mum! I was found not guilty!!! Thumbs Up Thumbs Up Thumbs Up Thumbs Up Thumbs Up
My word against the Policeman's, he did help a bit by saying in other words he disliked bikes! He said:

"I disagreed with such powerful bikes being used on the road"

It was annoying the Officer was not present when i received the not guilty verdict Evil or Very Mad But im sure he will get the message!

I also get to clame back all of my expenses, which will be days off work and traveling costs so im looking at around £300

Just goes to show that the police enforce the law, they are not the law.

It is very dangerous to assume that a policeman knows the law and always applies it in a fair way. (we all have first days on the job Smile)

If you feel you have been hard done by, or the police have not done there job properly you should always, with legal advice, challenge in court.

Just Like this lucky bar-stand Smile

I wonder if MAG should put pressure on the police to set up an education program for groups of motorists in the same way that they do for ethnic and other minority groups. From what I have heard some police range from unsympathetic to completely anti-bike (unless you run into a fellow biker).
This SHOULD NOT Factor in the application of the law!

I think the Policeman's shit attitude came across in court and the fact he had changed what he said from his original statement! The thing that makes me laugh is how much this would have cost the taxpayer and it was all a wast of time, i mean it was adjourned 4 times! Just for crossing a double white line!

I'm in a similar situation at the moment, I was in a crash in January and the police officer who attended has decided i was driving without due care and attention, even though i checked the road ahead, indicated, etc... i was pulled out into by a driver who was going to overtake as well and simply didn't look, yet the officer decided i was commiting an offence... i have no solicitor or witnesses but as it's my word against his, surely i should be fine?

Get together all the evidence you can, and make sure you are well prepared. Wright out a sheet of the Key events in the incident.

If you've not written it out get it down on paper now.

Pick it up and read it every so often, as you remember different things include them on your statement.

Lean your statement so you can quote it verbatium.

Well done, hope I am as lucky when I go to court in February over my crash in April this year. There are 2 witnesses who have in their statements quoted a different speed that the old guy was doing when he turned into my path. I have no solicitor yet, might just take advice from the duty solicitor, but I am pretty good with words and will be able to argue my point with them all.

Check whether you still can. Depends on what you are being prosecuted for. They changed the rules a couple of years ago to help along the profits from scameras.

Witnesses estimates on speed would never be considered as primary evidence as they're not experts on speed (e.g. witnesses almost always overestimate what speed a bike is/was doing) though I guess they could tip the scales if the magistrate was on the fence about it. What they saw is much more important evidence.
