I bought this bike off ebay last night.

The bloke says it works perfectly,and he has the log book.e.t.c.

When i got there i noticed the zorst was blowing but he said it was just where the front pipe joins the rear,and that it just needed tightened up.
Well it turns out it has a hole in it.
He also said he did not have the log book as he just bought the bike,but when i checked the auction again he said he had the bike 6 months.Anyway no big deal.
Took the bike for the mot and it failed on the exhaust and rear brake disk.
Brake disk new is£100 and fitting at least £50 as the allen bolts are rounded off,which the mot bloke said wasdone recently as they were still shiny.so the bloke i bought it off obviously knew about it.And the new exhaust would be £££'s

Do i have any rights legally to either get my money back or anything.Whats the best thing i can do.

But to be honest you had checked it before you bid on it didn't you.....
As ever buyer beware. You entered a legally binding contract.

Pipe you should be able to bodge with some gum and plate... Even a coke tin wrapped round and a couple of jublie clips to hold in place will do. It looks in far better condition than mine....

Disk should be less than £100. But fitting will be a pia if the bolts are rounded off...

Did you get anything of the V5 from him ? You should have just a little tear off strip.

He says in auction he has the V5, perhaps thats the leverage you need......

Have you taken it away & paid him the cash?

If so I woudl say this has limited your chances of comeback, as it has not been sold with any warranty.

On noticing the exhaust and lack of v5 I would have walked away, or negotiated a discount as the item was not as described in the listing.

You would have been well within your rights to do so.

If he actually lied to you about the condition of the bike then you do have some comeback. If he just didn't mention it, or you didn't ask, then he's not done anything *legally* wrong. The eBay auction clearly states him saying it's in good nick though, so you're sorted on that front. Print out the auction page and keep several copies just in case.

Ask him about it first, maybe he could give you some money back or something. If you do it in writing, then it may help with what I'm going to say if he isn't compliant. Be reasonable with him, keep your cool, don't lower yourself to his level if he gets arsey.

If all negotiations fail, then it'll have to be small claims court. You pay £30 I think it is, and then if/when you win he has to pay you it back in addition to what you claimed for.

Not that you should have to repair it yourself, but if you do, the exhaust can probably be welded and for the rear disc you could try a pattern part?

I checked the bike over a little first at his house,but im not all too experienced with bikes so didnt really know what to check for.

Just before i bid i mailed him asking if it was ok to come and give him the cash for the bike that night as i didnt have paypal to pay him the £100 deposit he wanted,and he said yes no problem so it made me feel like i had to take it anyway so i didnt argue.

Where the hole is on the exhaust is where 2 of the front pipes go to 1 onto the back box,and it cant be welded as the surrounding area is too weak with rust.And because where it is it would be really hard to do a bodge fix,and wouldnt last long anyway.

He did give me the tear off slip of the log book so i spose im ok with that for taxing e.t.c.I just assumed that because the auction said v5 present that it would be the full v5.

Anyway as for the brake,i had a ring around and found a used disk for £20 quid Thumbs Up So ill spend the day in the shed tomorow trying to get the old bolts out.
The exhaust is the only problem really.(and the speedo cable that fell to the floor while coming back from the mot Rolling Eyes ,And the REALLY tappy sounding engine that only taps when its been run for +10 mins Crying or Very sad )

Ill just take it as another loss and throw cash at it until it works,as i do with most of my bikes.

Apologies if you know this already, but best bet is to use (or buy a cheap set) a star bit, like you get with the multi screwdriver type things, hammer the fucker right into the allen nut, and undo. Have done it more then once, using the same star bit too.

Hope you are successful, the guy sounds like a prick, who took advantage of your good nature. Just take comfort in the fact you're a better person Thumbs Up

Do a HPi check on it. RAC are doing them for a fiver.

Worth it as one bike I almost bought was written off as a cat C a year after it was registered and again 3 years later.

My ER-5 is a Cat D. Although this is light cosmetic damage, it'll lower the resale value and put potential buyers off if I was to sell it.

Are we looking at the same bike here? Confused

How can a 4 into 1 nexxus stainless steel exhaust be rusty and have a hole in it?

sounds like hes had you over. I would note every fale claim he made in the ad and note any repairs needed and send them to him through ebay. He may have been unaware or stupid so see what he says.

The biggest mistake here was you not checking it over properly when you had the chance before buying it or taking someone who knew what to do.

Hi

It is an auction and a private sale so you have very limited come back.

Disks on Yamahas are a pig to get off as they use really soft bolts. Heat and an impact driver should (eventually) do it.

The exhaust looks in decent condition. Hopefully it can be welded by a half decent welder.

I'd be suprised if it's had a nexxus on it (4 to 1) and it's rusted, but if you lift the system off (not looked at any pics as Ebay=banned) then a welder could fabricate a few metal parts to cover the rust/hole and them weld them on as a cover for the failed bits. I've bodged up quite a few exhausts in my time (including my old Divvy), so it may be possible to bodge the hole shut with a good chunk of exhaust putty, tin can and clips as previously suggested. Pack the area of the hole with a load of putty and try to make it into a round section that the clip will go straight onto. get two strips of coke can that are wide enough to cover the area and stick the first one onto the still damp putty, then put a little putty on the second strip and layer that over the first, making sure the 2nd strip covers the ends of the first.

then put a hose clip on either end (not the middle) of the repair (where the putty is thinnest) and tighten until nice and secure but make sure the putty doesn't squirt out of the bodge....

leave it for a few hours (or overnight) and then fire it up. don't rev the nuts off it at first just in case the inner putty is still setting.

Oh, and all Divvy engines rattle, they just do. Something about the shafts in the gearbox...

If it clatters loudly when revving then that's another problem (bearings failed)...

I understand why you bought the bike I can appreciate that, but my number one rule when buying vehicles is No V5 = No Sale. I've driven halfway across the country before now, and walked away because the muppet said they had the "log book" only to find out they had the "owners manual" not the V5. I know you can do HPI checks etc... but there's really no excuse for not having the V5, even if they've lost it they should apply for a copy as soon as.

Seems he has got the V5.

Its upto the seller to return the rest, all you get as a buyer is the little tear of bit.

I'm thinking he maybe removed the system and stuck a steel one on?
I just cant see how stainless steel can rust out?

I'm not disagreeing with you and dont doubt you as you have the bike but i'm just saying I still cant understand it Confused


Also a little tip (too late now though) but print out the description from ebay and take it with you when you view. Take a marker pen and cross off any bits he has not been honest about. Then decide if you are willing to take the chance.

Ebay may be a online auction but you still have rights before you hand any cash over. The bike/item must be as described in the auction or you can walk away and file a snad (significantly not as described) claim against the seller.

Well,i got stuck into the back brake today.
Trip to consett for the brake disk £20 Thumbs Up
Took the wheel off and into the shed with it.
30 mins with a blow torch and some mole grips and the bolts came straight out Very Happy Thumbs Up

Took it back to the m.o.t. place and it passed (he let me off with the exhaust as long as i get it fixed a.s.a.p. so i give him an extra £10 beer money Wink)

Spoke to the bloke again and he said rather than getting his ebay name trashed he would try and get me a replacement back box,and seemed fairly genuine about helping me out.
His words were "Ive been ripped off before and i know how it feels,so ill try t help you out" Rolling Eyes
He also said hes working down south now so he has no idea when he will look for the replacement...Im not holding my breath Confused

Oh and theres definately no way the clamp over the tin can thing will work because of where the rust is(funny shape).Ive used that bodge many a time on cars.Will see what i can do with it tomorrow,but for now at least its m.o.t.'d Very Happy Thumbs Up Thumbs Up

There are different grades of stainless steel. However depends where the hole is. Think on the Nexxus systems the downpipes are stainless but the silencer section is just normal chromed steel.

Chemical metal? That would probably do it. I managed to 'weld' a thermostat housing together using this on a car and to my knowledge* it's still like that today and waterproof. Thumbs Up

*Guy down the road bought it and has never done anything to it apart from drive it.

Keith said that there are different grades of stainless but the silencer is normal chromed steel.

If it is rusting then it should take chemical metal ok. I also 'welded' the bottom of the back doors on a transit like this as they were rusting badly.


Someone please correct me if I am wrong as this is merely a (non) educated guess (seem to remember something about this from a book) but if it is rusting then the surface is porous. If it is porous then chemical metal should stick nicely.
