Had a quick search of google but still could not find much so here is my question...

Are there any laws regarding to the consumption of alcohol and pillions?

I know that a passenger in a car can be absolutely sloshed and be perfectly legal but was wondering about the laws on pillions. Even though they are not actually the "rider", surely they still do have a certain amount of control on the steering of the bike ect.

Don't know about the law, but i sure as hell would not want anyone on the back of my bike who was not in total control of their functions.......

They fall asleep they be off at the 1st corner, taking you with them....

Never mind the fact you may well end up with a multi couloured jacket... Sick

Gotta agree. Dont think theres a law about it, but it could be pretty damn dangerous if someones had just enough they feel brave/stupid/suicidal/funny/sick/dead.

Brave - "Hey, look at me! I can stand up on the back and put my foot on your he-" ...*death*

Stupid - "I wonder what'll happen if I try and jump, Steven Seagal style onto a passing branch!" *death*

Suicidal - *Vroom/Jump/thump/death*

Sick - *bleaurgh* *You kill them* *death*

I'm fairly sure I've read on here before that they (and possibly you as well, even if sober) would get done for drunk driving. In a car they have no control over where the car is going but on a bike they certainly do.

Dont think there is a law, just common sense on the part of the rider. As for those saying the pillion can affect the control of the bike, remember the pillion doesnt even have to be facing the direction of travel Laughing

I don't consume alcohol anytime the day before I ride my bike and as I ride most days I tend not to drink at all, I would expect my pillion to respect that as well and wouldn't let them on the back if they had had so much as 1 drink.

I value my life too much and my daughter needs her mum!!

Second stormer66, im sure i've read in the past (think when i was "studying" for my theory last year and generally looking into biking) there is a law because the pillion can control the bike to some extent. Think the limits the same as rider and the rider can get done for it.

depends on the drunk I suppose , I got home from a party last year with all my riding gear still on with me collasped in a heap in the hallway.

A buddy had picked me up , tied me to the back to his top box and rode home with me pretty much passed out.

My bad its not an offence unless theyve changed the law since, just found this article where a crash killed the rider and pillion. Pillion was twice over the limit but no offence committed although looks like the general verdict is he did contribute to the crash.

Can't find a thing about drunk pillions, guess the closest law is going to relate to unsafe loads if they are really all over the place. Wink


I've carried loads of people on the back of my bike who are a bit wobbly, never found it to be a problem. Surprising how many fall asleep.

I got told on my DAS that pillions are subject to the same Alcohol limit as the rider. Confused

People put too much value on absolutes.

Drunk people can be perfectly sensible.
Sobre people can be complete twats.

The trick, to my mind, is to judge people on their behaviour, rather than abstract conditions that may bear no relevance to it.

I agree but sometimes that bit of fun fluid makes them fall back into that twats section. I wouldnt let a drunk person on my bike as they may put us both at risk.

Just checked it out here in NSW Australia and it took 3 people to get me an answer.
Simply because it's not listed or refered to in the riders handbook.
Plenty of information on the rider but no pillion.
After seeking the advice of a supervisor I was informed there is not limit for a pillion on a bike.
Obviously they were quick to add common sense should prevail in this situation.

I would still be curious if pulled over while pillioning a pissed mate what they would try and stick you with.

Well, I suppose they could get you in a roundabout way

For instance, yeah, say you judge them on their behaviour, and theyre acting perfectly fine, a little tipsy and cheery, but fine.

Then the exhilaration of being on a bike makes them "wooo" for no particular reason other than theyve had a few - humans can be predictable, but they can also be predictably unpredictable Smile (phew)

They cause a crash, somehow, and you survive, they get injured badly and/or die.

Ive a strong feeling theyd find something to hit you with - be it putting an already "medium-risk-due-to-alcohol-content" person in an even more dangerous situation than being in a pub/club?

EDIT: They may even try to do you and say it was your fault for crashing? Neutral

Obviously worst case scenario and a bit far-fetched...but we've all heard worse things happen, have we not?

EDIT: Well, worst case scenario would be that your bike gets mangled and then you die - but who's nitpicking Thumbs Up
