Last night I washed the innards out of my year old arai as it stank like a dead thing, put them out to dry but this morning they were still wet.
So I used my old (possibly early 90's) Arai to go to work in.

Pulled up in the car park at work, stepped off the bike and promptly went arse over tit on ice, smacking the top lef hand side of my head on something. I got off the ground to find id hit a scaffold type pole sunk into the verge with 8 inches or so of it sticking out.

Apart from a stiff neck I'm otherwise OK, my trusty old Arai is very dead though. Quite a large dent and a perfect imprint of the end of the tube! I hate to think what would have happened if I was'nt wearing it.

I think I'm going to turn it into a hanging basket and put a claim in for a new one at work!

lol, was works idea. Think it's to stop me suing t hem for a scaffold pole stuck out the ground.

No McGee, it's why we arrrr roookkk sammee?! Crying or Very sad (no emoticon with slitty eyes). Claim for the arai off the work's insurance and say it cost you like 400 quid back then and it's worth the same now. I think motorcycle lids don't devalue which is why insurers just give you the latest lid for the price of the original.

Regarding the original question - I think you'd need to try it again without the lid to find out Wink

Can't say I'm in favour of claiming for accidents. We're starting to become like the States - a land of lawyers.

Yeah, if you'd fallen on a similar piece of pole, but didnt have a lid on which then resulted in a cracked skull and gave you a bad case of the black lung pops, I'm sure you'd just say, "ah health and safety is so fucking American and irrelevant right now!" Thumbs Up Wink

Then it would have been a different matter, as someone would have been hurt. Im not saying you should never claim for something, just you shouldnt claim for something like this. No-one was hurt, no-one died, no animals were harmed.

It would have been different if a kitten fell on it however...

Whats the diffrence between someone getting hurt, and the OP now having to fork out a load of cash to replace his helmet.

The company should thank their lucky stars that he DID have his helmet on...
Otherwise it would have been a very serious health and safety issue... With the H&S crawling all over the place.

£400 is going to be a cheap payout. Had it have been his head it would have been in the £'000 and a good chance of a very large fine.


Its not a case of claiming for claiming sake, its the decent thing for them to replace it FOC to the OP.

Its just a case of saying to the employer if they could give you a couple hundred quid to go towards a new helmet (would be replaced whether or not it hit the pole or not) and say that if the poles not removed within 5 days, you'll take it further.

Seems like a fair compromise that doesn't go down the American "pay me £5k due to the stress I have had due to this incident"

I disagree.

He slipped and banged his head - a simple ACCIDENT.

The pole being there is just being used as an excuse to fleece the employer.

The decent thing to do would be to simply point out that the pole is in a dangerous location and should be removed.

I dont like the sueing culture in the country.

But when I say that, I normally mean how doctors get sued (which should be against the law).

Get them to buy you a new helmet and then send it to me \o/.

most things have disclaimers written on them these days due to litigation , hell even signed audit opinions tell you not to trust the audit opinion and thus you cannot sue for damages , which is completely ironic cus you have an audit in the first place so you can put faith into the figures
