Hello all

Pardon my choice of french language but today has been a fucker of a day.

I walked out of work at 9.30 this morning cause i've had some dodgy throat infection for the last few days.... ring the quacks when I get home and 15:50 is the soonest they can book me in.

Anyways I go to the quacks, get a prescription for my throat etc and proceed home to get some money so I can pick up my prescription...

I get to my road I'm only travelling at 25-30mph tops and see a car/van at a side juntion on my right he looks straight at me then pulls out..... I hit his front passenger side wing and took a unpaid flight across the idiots bonnet....

First thing I noticed was the guy was trying to start the van and I jump straight to my feet, the bloke gets out and then says "I didnt see your lights were they on?" to which I pointed him to the bike and said of fucking course they were you idiot they are ALWAYS on.

We exchanged details and I had a 3 hour stop in the A&E department, i thought i'd fucked my wrist again cause my right thumb has swollen to resemble a chicken leg.... turns out im just bruised and battered.

The police turned up whilst I was in A&E and went through the accident with me, It appears that they may be prosecuting him anyway for careless driving as there was no visual obstruction blocking his view, but the officer will be phoning me tomorrow to get a statement if I wish...

The bikes pretty fucked, forks are twisted and bent, the rear indi's have smashed and the brake lever has been bent forward and apparently puntured his car.

What a fucking great start to the christmas holidays!!!!

Will post pic's when I get the bike back from my mate tmw. Crying or Very sad

Flipk out Sad

Cheers tiger, I'm quite lucky I suppose any other day I'd be blasting down my road to get home... today I decided it was too slippery to risk being valentino rossi....

I'm just annoyed abit more about this cause the guy claimed to be a bit of a biker himself..... which made me think hmmmm yea well not too observent for a biker.

Oh well at least I'm alive, just walking a bit funny lol

..TBH I don't always wear one myself, but it doesn't give the excuse for the driver that he didn't see you!

Take it that your bike is going to be a write off??

...well, if so, hope you get the insurance to sort it out quickly for you, and get yourself back on a bike soon

Thumbs Up

And his point is... Its not law that bikes have to ride with lights on, in fact i now ride with my off more then on. Shocked
In fact that comment may well be what prompted the officer to go DC route.

Get well soon mate Thumbs Up

Yea but what made me laugh about that comment was the light was clearly on and amazingly didnt smash when I collided with the car.

Also cause it was a fairly recent honda the lights are on whenever the ignition is on, there is no off switch only dipped lights or high beam.

Update with a few pictures of my bike, just picked it up today.... should also be getting a hire bike soon too.

The police are putting it to the CPS to prosecute based on my current statement they think thats enough evidence.

And the 3rd parties van

https://img.photobucket.com/albums/v330/flippy2k4/18th%20December%2007%20Crash/DSC00540.jpg

The insurance people want to pick my bike up some point today... is this normal.. I was also told by the accident support number I got only 2 weeks ago that i'd be able to tell them if I wanted the bike repaired somewhere in particular.

They will be getting me a replacement lid.... which is good.

Can anyone give me advice for what to expect from my and the 3rd parties insurance company.... will it be relatively quick to get myself back on a pair of wheels which are mine and not hired tyres.

This is the first time i've ever had to deal with any insurance company due to an accident.

Usual affair , he'll deny all responsibility say you were speeding , blank you for months hoping it'll go away.

*Bump*

So finally today I get a phone call from Bikers Legal Defence telling me the bikes a write off and is deemed unsalvageable.

The third party insurers have accepted full liability and will be sending me a cheque shortly.

Result!!! No disputes, Not alot of hassle apart from the fact I'll have no hire bike 7 days after I recieve the cheque.

What made me chuckle aswell is most of the people I know said I wouldn't get the full value of the bike back as they'd use the gay parkers guide and price it up from that or similar, well they paid the full amount (what I paid for the bike) which was £1200 and given me £245 on top of that to replace the damaged lid and gloves....

So now my next step is to find a shit hot training centre to do my Direct Access course with.....

Very Happy Very Happy Thumbs Up

Nice result considering the circumstances
You okay and healed up well?

This is how easy it should be, SMIDSY, insurance pays out, he more than likely wont do it again, you arent out of pocket. Thumbs Up

His mistake for not seeing you, at least he seems to have accepted it was his fault and sorted it quickly for you

Yea im better my knee still hurts if I bend down putting my wieght on it and my foot randomly hurts but I'm back at work and beavering away as per usual.

I'm excited at the prospect of being able to get something a bit faster to be honest, although I dont think I'll be jumping on anything too large straight away.

Nice one, this is how it should be. You did everyhing spot on.

~Got his details
~Went to A+E
~Spoke to police (the fact they were prosecuting the driver means his insurance can't deny liability?)

Good result, pleased for you Thumbs Up

Remember, when approaching a junction with a car waiting it may be an idea to do a quick mirror check, roll off the throttle slightly and cover the brake.

I've been there before with a woman who looked straight at me then pulled out, with me almost slamming into her door. Not good.

Me too, its the way they try and totally ignore you like you don't exist afterwards as your riding a long and banging on their windows. Ohh then they try and speed away.

What i've found is a downward fist action on the wing mirror helps.

The time I mention I believe I stopped within inches of the car. I kind of stared at her, wide-eyed in a "What the $%*£ just happened?" type moment.

She just waved a hand up as an apology then sped off.

I was far too glad to be in one piece than to worry about smashing her shitbox motor up. If her awareness was that bad then would she even notice?

Nope, I'm just a little more wary from now on. First look at them to see if they are looking, then keep one eye on the car to see if they 'have' actually seen you.

Grrr Thumbs Down

I often get more worried when you can clearly see then look in your direction, then the other way....

I think they see but don't register. Twisted Evil

that bikers looking at me, i want to pull out but hes coming in my direction, best pull out hes close to my bonnet now.... ooops. Doh!
Blame it on his speed and say you wernt looking at him at all then you can say sorry and that you didnt see him then the police will do him.
Then proceed to kill all the people who stopped me fleaing the scene.
*the thought process of the average car driver*
