speeding fines

arrived home tonight and opened the mail and was quite surprised to find i have been summoned to appear in court on 10 Jan for a speeding offence.The date of the offence was June 16 2007 and this letter/notice was delivered today Dec 20 2007 and i have received no other letters between these dates.Is there anyone familar with these procedures to see where i stand as your help will be appreciated,thanks.

Hi

First thing is to get over to Pepipoo.

They should have sent an NIP to arrive within 14 days of the offence. However no doubt they will claim they did and that is generally all the proof the courts want.

Over 6 months. Completely Invalid! Keep the envelope as proof, and they won't even get into the courtroom. The prosectutors are having a laugh!

Eh?

I believe the CPS has to present evidence to the courts within 6 months of the offence, providing it's not a crown offence, where it's 7 years.

When you get a court date is separate to that as far as I know, so I don't see having the envelope would mean much.

Only if they don't claim to have issued an NIP within 14 days (and even then there are get out clauses).

It isn't yet 6 months so any rules on getting the details to court in that time are not relevant.

No, because they have 6 months to put it before the court (forget the actual exact limits), but the courts have a bit of time after that to process it and send it out.

ended up with 3 points £45 fine and £15 victim surcharge, no costs as i did not receive NIP.

So those committing victimless crimes (speeding - where no accident or damage was caused) pay for the victims. While those "creating" the victims (drunk drivers knocking people down/assault/etc) don't pay a penny... very fair.
