i hoping that someone can help me!!!! i was pulled by the old bill last night pushing my bike home from my brothers house. the copper is trying to do me for no insurance. he says you have to have insurance for a bike even if your pushing it on the pavement without any keys in it. does anybody know if this is law or if some jumped up little shit of a copper is trying to pull a fast one on me. any advice would be appriciated as i don't need another 6 points on my licence cos they'll be no point having my bike then, which will kill me. Crying or Very sad

If it's on the road, I'm afraid you do need insurance. Could have tried blagging that the bike was stolen by kids from your home and you had found it and was pushing it back? Confused

Hmm.
If it means losing your licence or something pretty near it, then I'd get a solicitor, at the very least for initial advice.

Best case, hopefully the cop will have found someone else to annoy, and not bother filing the paperwork for your case because it's so petty.

If not and you get a sympathetic magistrate I reckon you should be able to get it brought down a lot.

.. No legal expert though.

Mad god that makes my blood boil round are way we have a couple of scroats riding a reck all round the estate last night the bill were in our close when these b@astards came riding in the cops just sat there and did nothing even though as a collective we had complained loads to the bill about this problem ,they had them on a plate and did diddly squat Confused fight it if you can

When my NSR wouldn't start after a damp night, just after I had just got it, an off-duty copper stopped and helped me push it up a steep hill...

Any vehicle in a public place which includes a pavement must be covered by a minimum road traffic act policy for third party risks. So he is quite correct in what he says.

Were you wearing your crash helmet? If not he could have done you for that as well, as even pushing your bike, the law requires you to wear your helmet as pushing it is still considered as riding the machine, and as someone else said, if you were on the pavement, you could have got done for that as well.

BTW T.C quick question, do traffic laws apply on company property ie. supermarket car parks and petrol stations etc.. Question Had a prat of a Nova boy tearing round a packed Tesco car park forcing me to do an emergency stop. Evil or Very Mad

If the public have access by payment or otherwise, then yes they do!

So this would apply to supermarket car parks and petrol forecourts and pub car parks as well.

Someone I know has just got done for drink driving in a pub car park, even though he never actually left the car park. He's lost his licence for a year over it. He moved his car (nudging a wall in the process) and went back into the pub, but someone called the police. When they arrived they searched him, found the car keys and gave him a breath test. He's lost his licence for a year over it.

It would be silly really if the law didn't apply to any area the public has access to.

Talk to your loca citizens advice bureau - its worth a try.

Also they have replys to questions like these in the bike mage - the one I am thinking of is ride - they have a legal advice thing in the back (or used to). Their e-mail is [email protected].

Or push it down a massive hill and then jump on it?

Much easier to just say "you're on the road, you have to be insured" IMHO.

The fact that pushing a bike is part of the CBT implies that training is needed to do so, at least in the governments eyes. It's a bit silly if you ask me because you could push say a shopping trolley with and engine in it that would weigh almost as much as a bike on the footpath without insurance.

As Ste says, I recon it just because it's the easiest way to have the law set up, as it's not really open to interpretation.

To me thats all shite. Pushing ur bike on the pavement and not wearing a helmet, have they nothing better 2 do, thats even worse than getting done for 32mph in a 30mph zone. Good luck m8!!.

So I guess you can only push a bike if your insured on it and have a license to use it. Rolling Eyes Does this also mean that a non biking mate cannot help me push my bike?

Actually I remember getting done years ago pushing a field bike home. To get around such laws it mustn't have the chain on.

I doubt it has changed. Find out if it's true then should he follow it up you could say it didn't have the chain on. I'd guess he doesn't know about that and didn't point it out on the night either. Rolling Eyes

The fact that it is a motor vehicle (cycle) on a road and capable of being ridden is sufficient, for it to require insurance, MOT (if applicable) and a helmet to be worn if it is capable of being ridden either under its own power or down a hill under the forces of gravity. As for the chain being missing, that has no bearing on it what so ever, it still remains a motor cycle under the Road Traffic act and it is still capable of being ridden free wheel down a hill when the opportunity arises.

The only difference it has from a bicycle at that moment is that it happens to have a useless engine as luggage.

The bicycle needs no licence to ride, no helmet to ride (or push), nor insurance.

Seems that you can be done for drunk in charge of a vehicle if you have the keys on you. Wonder how long before someone tries bending the law to prosecute you for "riding" without a helmet just because you have your bike keys on you. After all you are capable of riding the bike when the opportunity arises.

Sorry, I hate pointlessly bureaucratic rules, and some of those enforced on the road are definatly pointlessly bureaucratic.

A long while ago my Dad bought a car without an engine for a rally car project. As they were towing it home a real nasty copper stopped them and said, "right i'm going to throw the book at you, no insurance etc". The he opened the bonnet and said "where's the engine?!" He had to let them go Laughing.

Yes I am afraid so. Everyone knows the rules (or they should). If you own a vehicle and it is parked on the road, it needs to be insured against third party risks, whats the difference, except for the fact that it was being pushed? It was still on a public road FFS!

I have reported people myself for exactly the same thing, and I have friends still serving who will also report in these circumstances. Ignorance is no excuse, and the rules were in place long before many of you were ever conceived and for good reason. Sorry, but if you don't like it you know the options?

If someone has a genuine grievance, then I am happy to help them, on some forums I have even offered between a 50% - 75% discount on advanced training courses to help them from a character reference point of view, but when it comes down to ignorance of the regulations, then sorry, most people in the legal profession who have a good name will say "sorry you are on your own" or there is nothing that can be done other than plead mitigation or they will say "cross my palm with a large amount of silver and I will see what I can do for you" knowing full well that the person will be convicted and they will be lighter in the pocket on two sides.

Feel free to flame me for my attitude, it really doesn't bother me. I have seen it from three sides (as a traffic cop, as a learner instructor and now in the legal profession) and when someone pleads that they didn't know or it is a stupid law, well they simply become seen as easy meat.

Many of you on here seem to think that the law is stupid. In some cases, yes the law is stupid, for example it is still perfectly legal to urinate in public from a horse drawn carriage, that is bloody silly, but just about all traffic laws are there for a very good reason, and whether you think they are stupid or not you can either choose to abide by them or stop riding.

I live and work in Reading, and every day on the way to work I see a number of motorcyclists riding like absolute tossers, and it is because of these tossers that we have the somewhat draconian rules. Sorry, but we have no one to blame but ourselves.

Ban me from the site if you like, I am not going to apologise for my rant, but I am afraid to say that some members really need to grow up and start thinking about having a more responsible attitude to motorcycling because I assure you, we will be legislated off the road if you don't.

I agree mostly. Most cops would use a bit of discresion in circumstances such as helping someone else push a bike, but it isn't unreasonable at all to say you need to be insured if you're on the road at all.
