360 Fault and Argos help!

Hi all

After a bit of almost legal type help for my nephew.

Basicaly just over a month ago he bought a 360 from Argos (I know how dare the git not buy it from his uncle - but since he lives 200 mile away I'll let him off), and it has recently developed one of the faults these things suffer from (not the red rings) the DVD drive will not open)

Now I know since its only a month and a bit old if he came in to my shop or a Game or Shitstation policy would be something along the lines of replace machine for them/get it repaird for them.

However he went in to Argos and was instantly told to ring microsoft and have them sort it out. He said he didnt want to deal with microsoft and if they would get it repaired for him he would be happy (at no point as he wanted his money back).

They simply fobbed him off, game him the microsoft number and said they can't do anymore!

I know this is a breach of his statuary rights, under the sales of goods act, but would like some kind of words for him to use on the phone to their head office.

So any one out there good with words and can give me a nice list of things for him to say while on the phone asking very politly to sort the sodding thing out before he goes to the CAB and starts having to write letters.

PS - moral of the story is dont buy computer related stuff from Argos!

It's simple. No need for fancy words. Insist they take it off him. Tell them you don't care whether they replace it with a new one or send that one back to get repaired, but it's down to Argos to sort it out.
It's their responsibility. End of.

Quite simply, they are breaking the law. They have to take it back if you insist (although they are within their rights to suggest it might be faster going through MS).

When phoning HO, just make sure you have the correct parts of the SOG (Sales of goods) act in front of you so you can quote them directly( https://www.dti.gov.uk/consumers/fact-sheets/page38311.html - links on the right hand side).
Also ask if you can record the conversation on the phone (you have to ask if you record - its a legal thing), even if you have no intention of recording it - it puts the shitters on them a bit as they think you will have evidence to back you up if they say they are wrong Very Happy

Normally once phoning HO though things move fairly quickly. Its also worth while spending 2 mins on the phone to TS letting them know what Argos said. You can also drop this into your conversation with them Smile

Yes Argos should sort it out, but to be fair, 360's break all the time, infact they all break, juts some last longer than others. Argos prob just got fed up dealing with them.
Ring microsoft and they will sort it out, relativley hassle free.

I was told by Microsoft that if it is under a month old it is the sellers responibility to replace the console. If over a month then it falls to Microsoft.

MS to fix them quickly. 2 of my consoles have gone now, and bothe were back within 2 weeks, good as new
Call them, they will email labels, they get it collected by dhl, and it is brought back to you as soon as
Probably quicker than haggling with Argos

Under UK law, your contract is always with the retailer not the manufacturer Smile

Do Argos log serial numbers then?

As above, as for serial numbers, doubtful they log them but its a hell of a risk if they do.

Few years back my friend changed them over and got caught , when questioned about serial numbers he then spent 1 hour shouting at grilling the store manager until he waved the white flag and changed it.

You would be surprised the power of the "ART OF BLAG!"

In all honesty you dont need to do none of this changing malarky, go there and throw the box to his face start making a scene. Its there fault fk $MS or whoever theyre trying to pass the buck to Middle Finger .

I had mine replaced in may and i brought it the end of december...shop did it fine, although they told me i had to go to microsoft a mate rang in for me, he was 24 and i was 16, maybe because im a kid they believed id believe anything...

Do you mean "don't" log them?

I know in my shop we take the serial numbers of all hardware we sell. Recorded in the system, allows us to track the console from our supplier thru to customer, so we can see if there is a problem with a certain batch etc as well as possible swapping of machines.

I think this may be his problem, the fact he is only young. I will be having a word with my brother and will get him told to go kick their arses.

we see a lot of pcs and hdd recorders with drives missing that are littlewoods returns. Also seen pcs that wont start because theres no memory in em. We had one with a letter from the customer saying it hadn't worked since new. opened it up. no memory. Stuck some in and lo & behold the customers details and files are all over the pc. Maybe the original memory disolved.... Shocked
Another fave is cameras that "dont work properly". Seems odd to me that they seem to work long enough to take a fortnights work of holiday snaps. Shame they dont work long enough to delete them as well as i've seem more than enough pictures of fat bastards in shorts sat round their food or their beer.
