Right I have now received two letters from the tax man, asking me for money and wants to know if I am working....

Now I have not been in the UK for a good 9 months.

Where did they get my yank address and why do they want money off of me even though I have always paid my taxes.

9 months... so thats still about 3 months in the UK resident,

the rules go like this,

if you are resident or normally resident in the UK , you pay UK taxes on your world wide income including UK, not withstanding double tax treaties which the US has had one for ages.

If you are non resident you only pay taxes on income that is generated in the UK.


You are effectively non resident but ordinarily resident, thus liable for worldwide taxation kinda,

being 3 months you've spent enough time to be resident sorta,

but due to the double tax agreement taxes income which is taxed in the US isn't taxable here, problem is with the US system is that its ALL self assessment while UK prefers PAYE,

you've two choices

DTR lower of, ignore it

ie fill in a UK tax return including the foreign pages , including days spent in the UK and any income generated here and put the US income (and the calculated amount of tax due to the different yearends) into the foreign tax boxes. They should in theory give you DTR,

EDIT ,

you might want to send them a letter detailing your situaition currently, but they almost always make you complete a tax return if you leave and for several years after too as a bit of spite, no really , Mr C who followed me from my first accounting job , and jumped accountants when I jumped , has been living in Canada for years , HMRC thought they had him on years of late tax returns, and had 1000s £ tax unpaid , they should leave you alone after 1-2 years of tax returns.

EDIT 2 even though the tax return deadline finishes on Thursday evening you can get a 3 month extention if they have recently issued you one late. And makes you avoid the £100 penalty.

Lots of people who leave actually get quite a fat rebate on the year they leave, though E another client of mine actually pays more where she has moved.

I just don't see how they found my US address Laughing

And I am a British citizen and resident I'm just on a kind of extended vacation. And they want to know where I am, where I am working or why I am not working and why am I not paying taxes.

When I was back last I was being taxed a ridiculous amount. Can't remember the exact wording but something along the lines of emergency tax and they stole a hell of a load of my pay checks amount for a good 4 months. I was get this back, but never did.
Hetz seems to have the best idea.

Never did like Lee McGee. Thinking

They'll find you. Write them a letter, explain the situation and they'll leave you alone. Or they'll make a clerical error and send you a bill for a million quid! either way it will be sorted!

Extended vacation ? ,

sounds like they consider you to be non resident but ordinarily resident,

and what form did they send you? ,

was it a yellow/grey type form saying general enquiry? , send me a scan

or was it a blue stripe across the top tax return notice? ,

Or was it a redish type one (very rare)

yellow/grey type just toss it in the bin, like I do, blue notice to complete a return , complete a return, take you or me 2 minutes to complete.

if you have your P45/P60 , I can help you get your tax back, cannie do anything about the NI as thats never refundable , but be a couple £100 quid in your bank account of choice. Send me some payslip scans or P45 scan.

Although you are probably not the pablo escobar type HMRC does have the power to arrest you at your port of entry and do all sorts of awful things to you.
