handcuffs ?

hi,
question thats been bugging me for a while, a question that no-one seems to know the answer to.

Arrow is it illegal for a civillian to carry handcuffs on them in a public place?
some security guards, water bailiffs and parks police(glorified council workers) carry them.

i herd that it is NOT illegal to carry them but IS illegal to use them.
i have seen them being openly sold on ebay, so whats stopping people carrying them whilst going about their daily bussiness? for what reason i dont know.
anyone shed some light on this?

Aye that Harry Houdini kept getting caught with them handcuffs on so they put him in jail.

Handcuffs
The possession of handcuffs is not prohibited by law. However, use of handcuffs amounts to an assault and is unlawful unless it can be justified. Justification can only be achieved by establishing a legal right to use handcuffs, and good objective grounds for doing so. Use of force must be reasonable, necessary and proportionate.


From a legal aspect any member of the public can carry handcuff(s) around with them, albeit genuine or replica. They are not offensive per se as they are designed to protect, the use may dictate them offensive.

so a civillian can legally carry handcuffs, but not use them.

wonder how long it will be before them chavs start carrying them to intimidate and as Gmanxiii said, use them as knuckle dusters.

It wouldn't make sense when you can just buy a knuckle duster that wont break your hands hitting with it.

There not new, if chav's were gonna use em they would be doing by now.

I'm pretty certain they'd have a hard job prosecuting you for carrying a few cable ties in your pocket though.

Ever seen someone trying to get out of even a short cable tie applied round both thumbs? It is most amusing, you kid on you are doing some sort of manual dexterity test with them:

"Right, hold your hands palms together, fingers pointing me. Ok, now keeping your palms and fingers pressed together, seperate all your fingers as widely as you can."... ZIP! *slips cable tie over both thumbs, pulls it tight and stands back to point and laugh*

I think you will find yourself arrested if you hit some one with a pair of cuffs Colin, the only difference between those and a duster is, its illegal to CARRY a duster as well as use it.

Am i right in saying if you did something wrong in a public place i could arrest you on citizens arrest?

I heard this somewhere before, but most people that do things wrong carry knives now and i wouldnt really wanna arrest them lol.

I was told (dont know if its right) that some one had to be doing something bad enough to warrant a Jail sentance before you could make a citizens arrest, doesn't sound right to me though.

Correct.

The same applies to the police - they will (and can) only arrest you for an offence that carries a possible gaol sentence.

Apart from in the case of violent crime, a citizen's arrest is something probably best avoided - the chances of being injured or left open to counter-allegations are too great to be ignored.

On Topic: you'll struggle to convince anyone that you were carrying 'cuffs for legitimate reasons, even if you use them during a justified arrest. Were I the defence solicitor, I'd be playing heavily on the fact that only a weird (and thus someone who can't be trusted) would be cutting about the place with cuffs dripping of his belt! Heck, I have sets issued to me legitimately, and they seldom leave work - you get too many funny looks trying to buy your shopping with a bat-belt on.
