PostPosted: 17:25 - 19 Mar 2008    Post subject: My friend's summons... Reply with quote

Just under a month ago my friend got pulled by rozzers..

She was riding a CBR125 on a provisional, with a pillion, and she wasn't wearing a helmet (her pillion was).

Her summons came through yesterday, they're doing her for riding something something accordance with license and riding without a helmet, seem to be ignoring the Ls?

What's she looking at? First offence and all that.

As far as I've been able to find out, riding without a lid isn't endorsable so 3-6 and a fine for the other offence?

I'm not sure if riding without a helmet is endorsable... something tells me it isn't

However, they could say riding outside the terms of your license or whatever, and in addition to that she could get done for riding without insurance, because riding outside the terms of your license instantly invalidates your insurance. It is also possible that riding without a lid could do this too...

If they want, they can throw the book... depends how crappy they are feeling I suppose.

If she is young, hopefully she will show deep remorse, be very apologetic and get three to six points.

I just wonder what was going through her head to attempt to do something like that in the first place?

No wonder insurance is high for new riders when people are doing that sort of thing. Confused

It will be 'driving otherwise in accordance with a licence'. In other words shes a learner with a pillion, so they did not ignore the L plates.

Probably 3 points and a fine for the pillion. £30 for no helmet.

Keeping L's on and having one of you not wearing a helmet is bloody asking for trouble. If you're going to carry a pillion on a provisional at least try and make it look legit...

Technically they could have gone for Unlawful Pillion as well.

Indeed!

In her defence, at least she had the consideration to give her lid to the pillion...

But it was fucking daft, no doubt. Not the first time she'd taken a pillion on the provisional etc, but will be the last - she has actually learned her lesson.

She didn't have Ls on. Her not wearing her lid was asking for it though. Previously she'd taken pillions with both of 'em wearing lids and no Ls and gotten away with it. Reckon she just got cocky on this occasion.

Can they do her for more than is on the report/summons? Because all that's on there is the outside-terms-of-license-whatever and riding without a lid..

Thanks all, outlook doesn't look so bad for her then!

How many points are you allowed on a provisional? Is it 12?

Sorry but riding with no helmet should be an instant ban.

It's about as stupid as you can get.

I think instant ban is possibly a bit harsh but I totally agree that it's pretty damned stupid. If not because it's pointlessly endangering yourself, then because you'd have to be pretty idiotic to think you could get away with it.. a £30 fine is laughable.

How do you figure that? Evil or Very Mad

I hate it when people say shit like that.

It may be a bit stupid and risky, but a ban?

It should be personal choice.

Dread to think how many bans I would have amassed by now from doing test-runs to the end of the street and back again. Confused Hardly crime of the century, really.

I think people need to take a chill pill. Last thing this country needs is more legislation.

All the best

If you choose not to wear a lid, then thats an increased risk to yourself and no body else. Whilst I'd agree that riding a bike without one might not be the most sensible thing ever, it should down down the rider to decide themselves if they want to wear a lid rather than it being the law to wear one.

I'm sick of these posts.

Stick your safety nazi bullshit up your arse and accept that not everyone would be as much of a pansy* as yourself if it were not the law, and that percieved recklessness can also be tactical risk.

Just my opinion of course.

Sorry but got to agree, its giving us all bad names, its a bit more obvious that not wearing a seatbelt in a car. Like I said in my first post no wonder insurance is going up.

Prove to me that insurance is going up because of people riding without helmets then. Question

Next you'll be wanting legislation against all activities regarded as risky by 'no-idea but have an opinion' Joe Public. Well, guess what fucktard. Bikes are considered dangerous and many people think we're to blame for insurance costs even if we are 100% legit, and riding with the equivalent of ten cows on our backs.

Jeez, you really are an idiot man. Thumbs Down

That is where they are doing her for Riding without In accordance to license, Fine + 3 points.

I got done for having my L plate snapped off at the back, half was visible, and the copper must have had a shitter of a day.

In terms of insurance, it doesnt affect quotes at all, its a LC20 offense, and i actually got a cheaper quote with it mentioned, than without.

They will only prosecute for what is on the summons - as I said LC20 is 3-6 points depending on if the Judge got a blowjob that morning.

You are allowed 12 points on a provisional... If and when she passes her test then she will only be allowed to rack up 6 before it gets revoked and she has to requalify.

Exact situation as my mate 4 years ago. Rode his ped with mate on back who had no lid. He got a £200 fine and 3 points for Driving without accordance to his license. Mate had no lid and they were riding on the pavement to get into his driveway.

I got done for something similar. My dad was on the back but twat was holding onto a cardboard box. It was ME that got done - had my dad been driving and i was on the back - wuda been fine.

In the end, I was fortunate enough to only get reprimanded for "driving without accordance to my license" - they dropped any subsequent charges - didn't receive summons. I got let off lightly - police that stopped me were standard bobbies, not traffic, but both of them rode - I was 17 back then.

At the very worst it's a 6 pointer and nominal fine. Mate got solicitor, paid a fee of like 100 quid for his services and got off with only a 200 quid fine/court charge fee ( i think THAT was the total cost) - got 3 points. Could be worthwhile getting a solicitor?

On the Helmet side of things.

My Dad responds to every bike accident in the area (hes a cop). And being a biker himself, likes to be first on the scene to sort things out.

The amount of close death crashes he has been to is unreal. And I was quite shocked when he told me how many dead bodies hes had to scrape up off the road.

Not a nice thought.
