Hi all, not sure if this is in the right section on the forum but i guess i was on my motorbike when the offence mentioned below was committed.

Ok basically, January last year i was allegedly caught speeding on the A34 Stafford-Stone road (yes yes, naughty me Thumbs Down ).

I Recieved a NIP sometime later and eventually a court summons for a date later in the year. I intended to attend the court even if only to see the evidence against me as it's a road i always speed even after the NIP was issued.

In the end i was working on the court date and misplaced the times so buggered up on my end i guess. I got a letter with a fine and had to send off my license to the DVLA only to be returned with the offence code MS90 instead of a SP30 which is what i thought i was going to get.

MS90= Failure to give information as to identity of driver etc 3points

SP30= Exceeding statutory speed limit on a public road 3-6 points

Can anyone explain to me why this has happened, it's not like they don't know where i live or who i am is it Confused Also why not throw the book at me too and give me the SP30 on top since that was the offence i was being prosecuted for Question

Any help on clearing this up would be great cheers Thumbs Up

Probably because you failed to turn up at court and tell them who was riding the bike at the time.

How you got caught there is anyone's guess as its clearly signposted that there are cameras and they are at least every half mile on that stretch, painted bright yellow. Confused

Bah, that's proberbly it, i just wondered why they didn't stick the other 3-6 points my way too, not that i'm complaining like Embarassed

Yeah i wondered how they caught me too, which is why i really wanted to see the evidence in court. It's a road i travel down 2-4 times a day sometimes and i haven't slowed down any since that day either and never been caught again Confused

anyway to actually see the evidence now or will that just result in more anal raping from the courts Sad Question

Hi

3 points for that is better than you would normally expect. Generally you will get hammered for 6 points for failing to say who the driver / rider was.

Did you have anything originally through to nominate who the driver was? And if so did you fill it in and return it?

They can't do you for both, as without you supplying the evidence to say who was driving / riding there is no evidence against you for the speeding offence.

All the best

Keith

What else are they expected to do? They could have given you a fine for wasting the courts time as well. Did you not inform them you couldn't make the court date?

I did get fined by the court, which was 3 times as much as the initial fine. I'm just saying it would be nice if i could see the evidence sometime.
